Destroying C.I.A. Tapes Wasn’t Opposed, Memos Say

WASHINGTON — At a closed briefing in 2003, the chairman of the Senate Intelligence Committee raised no objection to a C.I.A. plan to destroy videotapes of brutal interrogations, according to secret documents released Monday.

The senator, Pat Roberts, Republican of Kansas, also rejected a proposal to have his committee conduct its own assessment of the agency’s harsh interrogation methods, which included wall-slamming and waterboarding, the documents say.

But Mr. Roberts, through a spokesman, denied having approved the destruction of the videotapes, which is under criminal investigation, and defended his record in overseeing the interrogation program.

His assertions were backed by his former staff director on the Intelligence Committee, William D. Duhnke, who said that while the senator had not objected to the tapes’ destruction, he was “in receive mode” and was simply listening to get the facts about the interrogation program, which he was learning about for the first time.

6. We should have kept those tapes as a monument
to our proud heritage of a country, right? If waterboarding the enemy was such a good thing, why didn't they brag about it before and while they did it? As opposed to hiding it?

12. Depends.Are you talking to me because overseeing your activity on behalf of the
American people is part of my federal job description?

IOW, people who tortured had a responsiblity to assess their own actions and inactions. But, so did those who encouraged them, enabled them, etc.

Then again, what is the point of devoting any time or mental energy to this? Prosecution went off the table a year ago.

9. Obstruction of justice
Destroying evidence of a crime is always against the law. Often courts will put people in prison for destroying evidence when that evidence wouldn't have been enough to convict them in the first place.
