Cornyn: Obama Got 'Lucky' That Times Square Bomber Is Talking

"That is a stroke of good luck," Sen. John Cornyn (R-Tex.) said of the news that Shahzad was cooperating even after getting his Miranda rights read to him. "What if he had not waived them and just quit talking, said 'I want my lawyer'?"

"Maybe we got lucky and said I will go ahead and talk to you anyway," said Jon Kyl (R-Ariz.). "But you didn't know that when you read the rights. So I stand by what I said -- it is better in these kinds of cases to get the intelligence first and then, if you decide you want to proceed with an Article 3 prosecution, then read the Miranda rights."


And DOJ officials say that the administration questioned Shahzad before reading him his Miranda rights -- the exact procedure that Kyl advocated. In the end, if the department wants to build a case against the suspected Times Square bomber, its hands are largely tied when it comes to what it can or cannot do both during interrogation and detainment. The Department of Justice under John Ashcroft understood this too. Which is why they not only read Miranda rights to suspected terrorists but publicly touted the convictions they were able to secure in criminal court settings.

because "THEY" refused to read the Hart/Rudman report, and ignored all the warnings, including the August briefing

The truth is that most of the problems we are experiencing today are because of the republican ideology. From the anti-union, anti-regulation, policies, to just pure incompentence

The guy that did this is an american citizen on US soil. What exactly would he like to do with him? Throw him in a prison without a trial? Sorry, the constitution doesn't allow that.

In fact Rehnquist himself wrote the majority opinion.

General Eaton bluntly said McCain and King are potentially putting American lives at risk.

Eaton, a political independent who says he’s voted for both Republicans and Democrats, ripped McCain and King’s comments as “wholly inappropriate,” adding that not Mirandizing the suspect risks making it tougher to win a prosecution of him in court.

“I don’t understand how a Senator or a Congressman can challenge the Mirandizing procedure,” Eaton, who is also a senior adviser at the Dem-leaning National Security Network, told me. “The laws are clear. Rep. King and Senator McCain have advocated a position that could cost us this case.”

Eaton added that there’s no way the suspect will ever be tried in a military tribunal, and said that his trial was certain to take place in the civilian court system.

“The offense occured at Times Square,” he said. “It’s not a military venue. He’s an American citizen. The military has no juristiction.”

... and hell, even the the cops beat him during interrogation, the only thing that would be struck out in court would be the results of the interrogation. It sounds like they have pictures/video of him at the scene, and records of him acquiring the vehicle, which would be enough to convict no matter what. Getting off on a procedural technicality when he's really obviously guilty only happens in movies or on TV.

John Cornyn is confused about what Mirandizing means. And besides, it's not like the guy didn't have the option of not talking before he was read his rights.

They have also said that we were lucky that the bomb didn't go off. Yes we were!!! But still, regarding 9-11, I am sure they would have spoken out against that "luck" too if we would have been,(ya, right) or IF the Bushies would have just read the August 6th Daily Briefing Memo. Too bad we weren't lucky on 9-11. Thank God we were "lucky" this time!!!!
