Families Win Multimillion Lawsuit Against Hemlock Associates Of Lakeville

BOSTON -- A civil rights trial against a homeowner's association accused of discriminating against Jewish members has ended in a settlement that is believed to be the largest in Plymouth County history.

A jury found Tuesday that Hemlock Associates of Lakeville, Inc. violated the civil rights of Donald and Julie Prescott and Scott J. Hyman after a 10-day trial in Plymouth Superior Court.

...

The families alleged that they were subjected during a two-year period to anti-Semitic acts, including hate mail and the painting of two large Swastikas on each of their respective garages.

...

In the deeds to some of the properties in the Hemlock Association appears language that the property should not be sold to a "member of the Hebrew race," attorney India Minchoff said.

In addition, within weeks of an association member's comments that "someone is going to burn him (Hyman) out," Hyman’s home in Middleboro, Mass., was torched and burned to the ground, according to Minchoff. There is an ongoing arson investigation.

Hyman said he also called a "kike" and was told by association members in the first few months of his purchase of land in the Hemlock Association that his "kind" was not welcome there.

3. Bigotry is everywhere. Even in "liberal" Massachusetts. This is
nothing less than disgusting.

I think some of those folks should do hard jail time for this...

4. Property deeds with restrictive covenants
i.e., "no sales to members of the Hebrew race" are still around. It's rare to see them attempting to be enforced, but antisemitism is alive and well in the U.S. In the fifties, some Florida beaches had signs posted saying "NO DOGS OR JEWS ALLOWED". Plus ca change...

5. I've seen the "we reserve the right to refuse service to anyone" signs used for this exact reason
Edited on Wed Jun-30-10 04:15 PM by superconnected
and my Republican friend insisted only last month that business owners should have the right to refuse service to anyone - if they're black, mexican, etc. Because he believes it's their business so should be their right.

This guy does not think on his own. He got this mentality from current rw internet sites. He's zealous about it.

8. Covenants such as those have been illegal in all the states
and under federal law for decades. Trying to enforce one is asking for prosecution under both state and federal statutes.

Thank God I live in a more enlightened area.

7. Can't say I am all that shocked.
While things like this may not be "everyday" common, there are still prevalent. Anti-semitism has gone underground in most places, but in some it is glaring. It invades every group, every political group, every aspect of life. Then again, according to a now banished poster, maybe it's actually the Jews themselves. :eyes:

10. But you have to love the association's defense ...
"We didn't do it ... They probably did it to themselves." Does that sound familiar to anyone? Maybe the tea party apologists, as directed by fox "news."
