Supreme Court Blocks Texas Execution

HUNTSVILLE (April 5, 2011)--The U.S. Supreme Court Tuesday blocked what would have been the first execution of a Texas death row inmate using pentobarbital.

Cleve Foster, 47, was scheduled to receive a lethal injection just after 6 p.m. Tuesday in Huntsville for the Valentine’s Day 2002 murder of Mary Pal, 47, a Sudanese woman who was abducted, raped and then shot to death after meeting Foster and another man at a Fort Worth bar.

It would have been the first execution in Texas since the state switched to pentobarbital in its lethal three-drug mixture because of a shortage of a drug it had been using.

Tuesday morning, the high court agreed to reconsider its January order denying Foster’s appeal, which raised claims of innocence and poor legal help during his trial and early stages of his appeals.
