Kloppenburg declares victory

Supreme Court candidate JoAnne Kloppenburg declared victory Wednesday, based on results reported by the Associated Press.

The Associated Press shows Kloppenburg received 740,090 votes and incumbent David Prosser received 739,886 votes. The margin is 204 votes.

In a statement, Kloppenburg said:

“We owe Justice Prosser our gratitude for his more than 30 years of public service. Wisconsin voters have spoken and I am grateful for, and humbled by, their confidence and trust. I will be independent and impartial and I will decide cases based on the facts and the law. As I have traveled the State, people tell me they believe partisan politics do not belong in our Courts. I look forward to bringing new blood to the Supreme Court and focusing my energy on the important work Wisconsin residents elect Supreme Court justices to do.”

Once again, an entire state is divided literally down the middle - I mean really - 204 vote separation out of nearly 1.5 million voters? It is almost absurd. Yes we have a lot of ignorant people here (willfully or otherwise), as in every state. We have our tea baggers, rich republicans, even white supremacists (way up north near Mercer is a known nest). But I just have a nagging feeling something is not right with these numbers. I wonder if there was some manipulation of the totals by those who tabulate the votes.

Prosser got 55% of the primary vote on February 15--most progressives who knew anything about the race were deciding between three unknowns to be the sacrificial lamb.

Supreme Court elections here are usually low-turnout blowouts. There has been one incumbent turned out in the last 40 years, before this election. That a virtually unknown assistant DA could even make it close, let alone win, is a testament to how angry people are.

But I wouldn't rule out corporate 'TRADE SECRET' voting machine fraud favoring Prosser and giving him a close enough count to tie things up for a while and maybe even pull off a win.

I understand what you're saying about the nature of the race--and what a spectacular victory it is for progressives even though it was close. I just don't trust these machines AT ALL. I think they've given us nutball fascist governors, Congessional reps and state reps, who DON'T represent the people, because they can--they really CAN--do it. There is basically nothing protecting us from the SECRET CODE--that we are not permitted to review--used for vote tabulations. It is hugely scandalous--an assault on the bottom line of democracy, an honest PUBLIC vote count--yet no one talks about it. Amazing.

They are counted by machine, but will be recounted by hand, in front of witnesses, including legal observers and others sent by either campaign and by the public. This race seems only as hackable as people in general are.

They're pencil-and-paper ballots, no hanging chads or holding the ballot up to the light to figure it out, and, if voter intent is clear, the ballot will count even if the voter made an error and the machine couldn't pick up the vote during the initial count (i.e. if someone circles the name instead of connecting the arrows, or if someone writes in a name that's already on the ballot, or someone used a writing implement whose ink couldn't be read by the scanner when filling out an absentee ballot).

So I imagine they have them in more populated areas. At least we still have the choice. I moved to this area in '08 and in every election since, the poll worker always asks if I want to use the computer. I don't think it gets much use, at least in this precinct.

If you look it up, you'll see that the computers were approved by the state in '06.

Perhaps there are still precincts that use different equipment. I only know the arrangement to purchase the e-voting equipment was made in 2001. Dane County had Optech Eagle before the Presidential election in '04. I am not sure which system we had for the 2000 election but I seem to recall it was the same or similar.

About 80 percent of Wisconsin's 72 counties and municipalities recorded votes by optical-scan or mark-sensing equipment; 7 percent used punch cards and the rest used lever machines or paper ballots. Fewer than half of the counties sent returns to the State Elections Board electronically.

142. Prosser won his last election to state SC with 99.5% of the 550k votes cast.

Almost 3 times as many people voted in this race and the number of votes for Prosser only increased by about 33%.

The shocking part in this election was, in fact, how close it was - but not for the reasons you think. For a virtual unknown to unseat a sitting judge is amazing. Seven weeks ago he was polling at 70%. The shocking part of this is how we turned this race around in 7 short weeks.

I am skeptical about the results, given our voting equipment and tabulation methods, and frankly, the many other cases of e-voting fraud in this country. If you can prove the election results accurately reflect the intention of every voter in our state, I will stand corrected. But I don't think you can do that.

I welcome a recount as long as it is done without "help" from ES&S computer systems , the Koch brothers, or any other known corrupt entity. This may be the only way we can find out how clean our election system really is.

If we notice any hesitation from Prosser in ordering a recount I will take that as a signal that they don't want us to see the real numbers.

155. Update regarding my TOTAL DISTRUST of corporate 'TRADE SECRET' vote tabulation.

This update is in view of the election theft for Prosser that is in progress in WI.

Those who say they "have a paper ballot in Wisconsin" don't seem to realize that,

a) The paper ballots are COUNTED BY the 'TRADE SECRET' CODE machines. They scan them into these corporate machines, and the corporate machines produce the totals. You and me and the general public are FORBIDDEN to review the 'TRADE SECRET' code that does the tabulation.

b) These optiscan systems are NOT secure. And one of the reasons they are not secure is that, along with bribing state/local officials to buy these very expensive, high maintenance systems, the corporations got LAWS passed that produce extremely inadequate audit and recount procedures. Half the states do NO audit at all (comparison of paper ballot to machine totals)--because there is no paper ballot. And the other half do an extremely inadequate 1% audit. (10% is the MINIMUM needed to detect fraud in electronic voting systems.) And then, in a close race, they do only a 3% recount. (Sometimes they go further if it stays very close.)

These two things--the 'TRADE SECRET' code (even in the optiscan systems), and the LACK of an adequate, or any, audit--make fraud EASY. It's VERY easy in the touchscreen systems (no audit), and just plain easy in the optiscan systems.

Why is there 'TRADE SECRET' code in ANY part of our elections system? You might well ask. Cuz our Democratic Party leaders let 'em do it, that's why. They should have screamed bloody murder about this. They didn't--out of collusion or fear. It was the Anthrax Congress that passed the $3.9 billion e-voting boondoggle that destroyed our voting system. That money was used to PRIVATIZE the system--bringing with it not just unverified--and unverifiable--voting results, but also the whole corporate culture of secrecy, exclusion of the public and corruption.

It has also brought corporate monopoly. ES&S, which bought out Diebold (aka Premier), now owns and controls EIGHTY PERCENT of the 'TRADE SECRET' vote counting in the USA. ES&S has far rightwing connections that would make your hair stand on end. (I'm not sure what corporation is 'counting' WI's votes, but it doesn't really matter. If it's 'TRADE SECRET' tabulation, it's bad.)

The only good news I have to tell you is that the Anthrax Congress neglected to mandate that local/state jurisdictions purchase and use these 'TRADE SECRET' voting systems. There is NO federal law requiring it. It was all done with filthy lobbying. It is still up to local officials--and, as long as that remains the case, "we, the people" have the opportunity to change it--to restore vote counting to the PUBLIC VENUE. (We have no such chance in Washington DC, especially with this scumbag, ES&S/Diebold (s)elected Congress.)

This was supposed to be the proverbial cake walk for the bad guys against an unknown woman whose name they probably can't spell. They still outspent her by huge margins. Fantastic! That's money that's no longer in their pockets. I always find myself wandering back over to glee about the huge checks that some people wrote and all those big chunks of money that aren't in their accounts or earning them huge tax-free interest or some such advantage anymore.

Granted people like the koch brothers won't feel it at all, except in their gigantic bruised egos. But perhaps to someone else who anted up on this, it'll mean the difference between contributing to the next candidate, or contributing AS MUCH to the next candidate as previously planned - or NOT doing so. Maybe they're budgeting for the rest of the year and realize they won't be able to give 1,200 dollars - it may only be a thousand dollars. Or maybe they'll only be able to spare $800. Yeah, sure, the game's really on next year but it's THIS year when candidates and wannabes start amassing war chests, to prove how viable they are. It's like they're all taking penis-enhancers now to prance around and preen their newly-fancied-up feathers. And maybe some candidates and/or wannabes won't get as much of that enhancement now.

Defeat scares some people. It knocks the wind out of the lungs and some people stand up again in defiance and others just lay there depressed and defeated. There are some people who are gonna get scared off. Maybe a little. Maybe more than a little. It won't be many at least for starters, but there will be some. You know how discouraged you get when things don't go well for America because the bad guys gain more power. They do, too. And we should capitalize on that.

You never know. The wannabe who MIGHT be able to amount to something if only he or she could build up enough of a war chest or gain enough financing to hire enough people and to get enough commercials on the air - MIGHT actually be rendered stillborn as a viable candidate, now OR in later years, with the kind of chill that could set in, starting with this victory.

The more and bigger a crisis of confidence we can engender among the bad guys and their ill-informed and gullible followers with a good break like this, the better.

This is a guy who was first appointed to the bench, then won a 10-year term in 2001, by running unopposed. This is a guy who, among attorneys practicing here, did not really register as particularly controversial until recently. Eight weeks ago, nobody knew who any of his opponents were. I am an attorney, and have been politically active in Wisconsin since 1993, and I had no idea who any of these people were. I voted for who I assumed would be a sacrificial lamb on February 18.

That it's even this close is amazing. It was never supposed to be this close.

That 1.5 million people voted, for either candidate, in an election that usually turns out half that amount is amazing.

More people voted for Kloppenburg than will be needed to force a recall of the governor. Hundreds of thousands more.

Everyone is on notice now that, in spite of the deep-red blip last November, Wisconsin is and remains a purple state. It won't stop Walker, et al, from doing their damage in the next several months, but if they do, they will continue to stoke the recall fires until they are actually recalled.

Regardless of who actually manages to win, democracy won yesterday. And that means a whole lot, at least to me, and to many of us here in Wisconsin.
