State asks Supreme Court to step in, halt restraining order

The Walker administration went directly to the state Supreme Court on Thursday to get it to lift an order blocking implementation of a controversial measure that sharply curtails public employee bargaining rights, telling the high court that a Dane County judge unconstitutionally overstepped her authority.

With an open meetings lawsuit over the measure still months away from a decision, lawyers for the state Department of Justice and the state Department of Administration asked the high court to end a restraining order issued by Dane County Circuit Judge Maryann Sumi, saying she does not have the authority to stop legislation before it becomes law.

The action filed by the state Department of Justice and the state Department of Administration is not an appeal of Sumi’s order but is instead a request that the high court step in and decide matters that are “of great public concern that go to the very heart of our constitutional system of government.”

The Walker administration is challenging Sumi’s authority to order that implementation of the union law be temporarily barred while a lawsuit filed by Dane County District Attorney Ismael Ozanne over an alleged open meetings violation proceeds. Ozanne’s lawsuit alleges that a legislative conference committee violated the state’s open meetings law on March 9 when it met to approve a whittled-down version of Gov. Scott Walker’s budget repair bill that removed fiscal elements................

the timing is very out of place. What are they so afraid of that they have to rush constantly thru this bill? I still think is is very fishy and I think they do so. I think JK has asked for information concerning the city's voting tabulations b/c something just is not right.

5. Here's the bad thing .....

Wisconsin is a State that Supreme Court has what is called "The King's Bench power" i.e. the right to take over any case presented in any inferior court at any time and hear the case itself.
So the union bill case that is before Judge Sumi could be totally taken over by the SC at any moment.

the Chief Justice, Shirley Abrahamson doesn't. She's also the one that Prosser called a bitch and told he'd ruin her...she decide's which requests to the court to attend.

Are you telling me that Abrahamson can simply refuse to hear a case regardless of what the other justices want? Even if the majority want to hear the case?

If so, all it would take is the Chief Justice refusing to hear any cases she might lose.

If what you were saying is true, the Prosser versus Kloppenburg would have much less significance.

I've got to think if the majority want to hear a case, the court will hear it whether the Chief Justice wants to or not.

...The petition also asks the court to immediately stay Sumi’s March 31 restraining order, citing lost fiscal savings to the state from being unable to implement changes to worker pay and benefits made by the union law. It estimates the savings to be $30 million this year and $300 million in the 2011-13 budget.

“Further delay negatively impacts the state’s fiscal health by not achieving these savings,” the petition states.

Ozanne said late Thursday afternoon that he had just received the petition and had not had a chance to read it yet. But he said he wasn’t surprised by it.

“Nothing really surprises me at this point,” he said. “It’s interesting that they didn’t call us before they went this route, but it is what it is.”

17. Time to gather information on republican owned businesses in Wisconsin

and make a serious effort at a nationwide boycott of these businesses.

Our political system is broken, money controls it. The courts are broken, money controls them.

It's a lock that they will overrule Judge Sumi.

It seems that one of our only recourses is to take measures to drain the money from the pockets of the wealthy RW private interests that are controlling our political system and judicial system with their wealth.
