A judge says she will issue a decision in a day or two about whether to dismiss a lawsuit challenging Gov. Scott Walker's divisive collective bargaining law.

Wisconsin Department of Justice attorneys argued Wednesday that the lawsuit by Democratic Dane County Executive Kathleen Falk should not be allowed to move forward because it is not ripe given that the law has yet to take effect..................

1. But, but, but... Their position is that the law IS in effect
They be smoking out of forked-tongue.

The bigger of the Fitz twins plus all the admin goons claim it is their position that the law is in effect and they are just humoring the judge in the other case.

Now they claim no one can sue because the law "has yet to take effect..."

Typically repugnant.

This is from another paper.


The Department of Justice argued the case should be dismissed for several reasons, saying the suit can’t continue because the collective bargaining measure is not yet law.

The agency is making that argument just weeks after fervently arguing in the case filed by Ozanne that the collective bargaining law had taken effect.

The judge expressed some skepticism about the case continuing.

“The question here is whether this case is the vehicle for challenging the constitutionality of whether it’s a bill or it’s a law,” Sumi said. “(But) what about the case before us? Principles of separation of powers don’t make the courts jurisdiction so expansive that everything that comes in can be litigated.”
