Gov. Gray Davis requested the FERC and a whole slew of federal agencies to investigate price gouging and energy hording. He even called Smirko personally. A world of good that did.

Remember the California energy crisis? As the implications of the collapse of Enron spiral ever wider, increasing attention is being paid to the close connections between the White House and the Texas energy trader. So far, there has been no evidence that Bush officials tried to stave off the Enron disaster. But the real smoking gun for Enron could be its role in the California energy deregulation debacle.

Vice President Cheney has already admitted that he and Enron CEO Ken Lay discussed the California situation in some of their six meetings last year, leading some critics to believe that Bush's hands-off policy toward the Golden State's energy meltdown was adopted at the bidding of Enron, whose profits soared during the crisis. Lay was also instrumental in replacing the chairman of the federal commission that regulates energy issues with his own nominee, after the original chairman refused to kowtow to Enron's wishes on electricity deregulation. A California state Senate committee is currently calling for depositions of Enron and Arthur Andersen officials to find out if the former energy giant or its auditors willfully destroyed documents that were under subpoena from the committee. And an ongoing criminal investigation by California Attorney General Bill Lockyer is still looking into allegations that energy producers and traders, including Enron, artificially manipulated the price of energy to profit off of California's poorly constructed energy deregulation plan.

Enron officials once took pains to note that California's problems could not be blamed on energy producers but on California's partially deregulated market, which they said didn't go far enough. But it's now becoming apparent that Enron was as responsible as anyone for the shape of that deregulation plan. As the Enron mess continues to heat up, California could prove to be the company's biggest political embarrassment.

The fast-moving story took another twist on Tuesday, when Joe Dunn, a California state senator chairing a committee conducting an investigation into possible price gouging, noted that Arthur Andersen, Enron's accountant, may have destroyed documents that had already been subpoenaed by the California Legislature.

34. Wilson's hands are all over this.
The Republicans pushed through a deregulation bill in 1996 that set the stage for Enron to take over, saying it would lower our power bills. Somebody needs to indict Republican legislators for racketeering.

From every story I've read, Lay will be indicted for "accounting fraud" that misstated the finances of Enron - not for any fraud or manipulation of energy prices!!

In other words, he's not being indicted for what he did to Californians -- hes' being indicted for not doing it successfully enough for Enron shareholders.

.... after 20 years on the left coast and those last years being robbed by Enron, Duke, Reliant. et. al. It's one of the times I'd be inclined to join a vigilante mob and drag those corrupt bastards to the nearest sturdy California Oak with a nice length of braided hemp -- for symbolic reasons, of course. :evilgrin:

"going to restore dignity to the White House, the people's house." You said

this standing in front of an Enron jet!



Man, you loved Lay so much, you not only affectionately referred to him as

"Kenny Boy," you interrupted an important campaign trip in April, 2000, to

fly back to Houston for the Astro's opening day at the new Enron Field --

just so you could watch Kenny Boy Lay throw out the first pitch. How

Prosecution rests….


In an interview last month with The New York Times, Lay took responsibility
for the company's spectacular demise but blamed any criminal acts on underlings.
Lay placed most of the blame for the scandal on Fastow, who prosecutors say
was the main architect of several Byzantine schemes that eventually were called
into question. Lay acknowledged, however, that he and his board signed off on
maneuvers that ultimately became troublesome for the Houston-based energy
trader.
In the interview, Lay characterized himself as one of the "98% of the people
who worked at Enron" who were "good, honest, hardworking individuals." He placed
Fastow among the other 2%.

"We had a chief financial officer and a few other people who in fact
mismanaged the company's balance sheet and finances and enriched themselves in a
way that once we got into a stressful environment in the marketplace, the
company collapsed," he said.
The interview broke Lay's 2 1/2-year silence about Enron's downfall. He was
called to Congressional hearings shortly after Enron's collapse but declined to
testify, citing his Fifth Amendment rights.

takes? It's like writing War and Peace or something. It really wears you down, looking for loopholes in tax law, ways to stiff the consumers and the employees. And then the excuses!

(I couldn't be happier except if news of a conviction broke in the middle of the ReThug convention.)

This was among the tricks several of us thought Bush might pull. One day too late, IMHO.

Kerry's bounce is already taking effect. As this plays out, all it will do is reinforce the view of Bush as a friend of Big Crooks. I think this is a knockout for Kerry and Edwards if they play it right.

Notice, they are the ultimate in "reactionary", or "re-active" (as opposed to pro-active, which means that they take care of things before disaster strikes).

In other words, they sit on their hands until they are FORCED to take action. Otherwise, they play the crony game, rigid and ossified in their decision-making.

Then, when events spiral out of control, they grudgingly do what's needed. But not until all their credibility is lost.

Like with Lay. They probably stalled and stalled, even though they knew something had to be done with the dude. Notice how they waited until the day after to snap into action.

Pathetic.

Our criminal justice system is fucked up. Guy writes a bad check for a hundred bucks, they'll raid his house like he's an Al Qaeda terrorist (and may very well have used the Patriot Act against him); guy steals a hundred billion from little old ladies, and it's "okay, just turn yourself in when you feel like it. And don't worry, even if they find you guilty, you're rich and white -- you'll only have prison Monday through Friday. Sorry, there's only nine holes available."

This guys is trying to tell me that all the bad stuff with Lay happened during the Clinton administration, and that Kenny Boy only had problems once Bush took office.

He sort of has a point but I think he ignores that Bush and Kenny go way back to Texas and Bush's run for Governor.

Prosecutors have aggressively pursued the one-time celebrity CEO and friend and contributor to President Bush who led Enron's rise to No. 7 in the Fortune 500 and resigned within weeks of its stunning failure. Barring last-minute delays, Lay is the 30th and highest-profile individual charged.

AGE - 62

OCCUPATION - Consultant; founder and former chairman and CEO of Enron Corp.

FAMILY - Wife, Linda; son Mark, daughter Robin from a previous marriage.

BORN: 1942 in Tyrone, Mo. His father, Omer, tried selling farm equipment and working in a feed store, but became a Baptist minister after bankruptcy forced the family to seek refuge with relatives.

EDUCATION: Bachelor's and master's degrees in economics from the University of Missouri; a doctorate in economics from the University of Houston.

WORK HISTORY: Senior economist at Humble Oil and Refining Co. in Houston, the predecessor of Exxon, in 1965. After earning his doctorate, Lay was an economist in the Navy, and in 1971 became Undersecretary of Energy under Rogers Morton. Envisioning a deregulated natural gas industry where the market set gas prices, Lay left government in 1974 to be an executive of Florida Gas, becoming president of the company by 1981. In 1982, he returned to Houston to run Transco Energy Co., and in 1984 took the helm of Houston Natural Gas. In 1985, HNG merged with Omaha, Neb.-based InterNorth, and the combined company became Enron with Lay as CEO. Enron reached No. 7 on the Fortune 500 in 2000 and claimed $101 billion in annual revenues.

POLITICAL ACTIVITY: Nicknamed "Kenny Boy" by President Bush. In Enron's heyday under Lay's leadership, Bush received more than $550,000 from the company, its employees and their relatives during his political career - the most from any source. More than 250 members of Congress from both parties also received Enron contributions, though three-fourths of $5.77 million given to candidates since 1989 went to Republicans. Vice President Dick Cheney sought Lay's input on energy policy and Lay routinely spoke publicly on economic and energy policy.

Wait forever, give Kenny boy enough time to dispose of assets in the US that could be touched by RICO or some other convictions. Remember the house sales, his wife poor mouthing and selling things?

Next, squirrel away that money in hidden and offshore accounts, untouchable, untraceable.

Next, let this drag past the elections. If Busholini wins, then nothing really bad on Ken, little fine, if any. Case closed. It was that evil mastermind, Skilling and others. If he losses, start the pardon mill going...

It all works out in the end for those who own the country.
