Reservist files lawsuit to block recall to duty (AP)

Todd Parrish served four years of active duty and another four years in the reserves, but believes his commitment to the military ended in December. The Army says Parrish never formally resigned his commission as a lieutenant and is still eligible for involuntary recall to duty.

Parrish says he did not know he had to resign. He has married, bought a house and began preparing for a career as a civil engineer since leaving the Army.

Parrish's lawyer, Mark Waple, says Parrish has until August 10 to report to duty. Originally, Parrish was supposed to report last month. The Army has granted him two 30-day delays while it tries to resolve the case.

Parrish is from Cary, North Carolina.

that'd be safe to assume....provided he's not in jail come Election Day for failing to report.

Catch 22 for all officers who don't read the fine print or the US Code.

retirees can't escape because they receive compensation for being in the reserves.
