http://www.nydailynews.com/front/breaking_news/story/213677p-183996c.htmlIn a ruling certain to affect protests at the Republican National Convention, a judge has ordered city police to end bag searches of demonstrators and to allow protesters to move more easily in demonstration areas.
U.S. District Judge Robert W. Sweet said in a ruling made public Monday that police will not be allowed to search the bags of demonstrators unless they can show a specific threat to public safety and explain how blanket searches can reduce the threat.
He said his order does not stop the police from conducting less intrusive searches of all demonstrators with devices such as metal-detecting wands.
Sweet said the city had “not shown that the invasion of personal privacy entailed by the bag search policy is justified by the general invocation of terrorist threats, without showing how searches will reduce the threat.”
He added, though, that the “ban on searches at demonstrations is not categorical and may be justified under different circumstances.”
