Appeals Court Questions Bush's Appointment
ATLANTA - A federal appeals court is asking the Bush administration to defend the president's appointment of a judge to its ranks while the U.S. Senate was out of session.



The 11th U.S. Circuit Court of Appeals (news - web sites), based in Atlanta, asked the Justice Department (news - web sites) on Monday to intervene in a case contesting the appointment of former Alabama attorney general William Pryor to that court.


Sen. Edward Kennedy, D-Mass., and others are backing a challenge asking the court to rule that the appointment was unconstitutional.


Bush appointed Pryor in February during a one-week recess of the Senate, which must confirm judicial nominees. The Constitution gives the president the right to appoint judges directly when Congress is not in session.

People, hello! They've asked the JUSTICE DEPARTMENT to intervene! Exactly what do you suppose the outcome of this intervention will be? Business as usual, Asscrack will rubber stamp this as perfectly normal proceedure and it will be forgotten.

Let's not forget who we're dealing with here.

5. Well who are they sappose to ask.? It just will put more light on
the fact that Bush had to do this--- also, the way Bush did this means Pryor's term will be up in 1yr for official nomination.

9. You are right about Ashcroft
But the 11th is a very conservative circuit court. For them to even ask for an investigation means Bush is in trouble. This really is one situation where the story would be more important than the result. After all, as a recess appointment Pryor is gone soon anyway.

That's the case Kennedy tied it to:

"He is now backing a challenge to Pryor raised as part of a civil rights case involving college students who were strip-searched after being stopped by police in Georgia."

10. I hope that this challenge is successful
The use of recess appointment is very controversal. I hope that Senator Kennedy is successful in his challenge.
