Extremist judicial nominee to 9th Circuit Blocked by Senate!

I just got an email from Earth Justice stating that the Republican majority fell short of the 60 votes necessary to force a vote on the nomination of Myers to the Ninth Circuit Court of Appeals. This is a great victory for environmentalists throughout the USA. If Myers had gotten this lifetime appointment, he would be in a position to impact 3/4 of this country's public lands.

WASHINGTON - Senate Democrats on Tuesday blocked a former Interior Department official who once worked for mining and cattle interests from becoming a federal appeals judge, using the debate to criticize President Bush (news - web sites)'s environmental record.



The Senate's majority Republicans were unable to muster the 60 votes needed for the confirmation of William Myers for the San Francisco-based 9th U.S. Circuit Court of Appeals (news - web sites). The final vote was 53-44, making Myers the seventh Bush judicial nominee to be stopped by Senate Democrats.


Republicans said Myers was the latest victim of Democratic smear tactics aimed at stopping everyone their interest groups don't like. But Democrats said Myers was a perfect example of negative White House's views on the environment.


"If you watch what the Bush administration does, instead of just listening to what it says, there is much evidence of this administration's outright contempt for high environmental standards," said Sen. Patrick Leahy of Vermont, the top Democrat on the Judiciary Committee (news - web sites). "This nomination in itself says something about that. I hope that the Senate's vote today will say something about the higher priority that the Senate makes of environmental quality."

Yes the 9th circuit is powerful when it comes to overseeing public lands.

That's why it's important to keep it a liberal court.

WASHINGTON, July 20 - Senate Democrats on Tuesday used a filibuster threat to block yet another of President Bush's judicial candidates, asserting that William G. Myers III, a longtime lobbyist for large ranchers and mining interests, was unsuited to be a federal judge.

Mr. Myers, who was nominated for a seat on the United States Court of Appeals for the Ninth Circuit, which covers nine Western states and has a docket rich in cases involving the environment and land use, became the seventh of Mr. Bush's judicial nominees to be blocked by a Democratic filibuster. The Republicans, who needed 60 votes to defeat the threatened filibuster, which is an extended debate, were only able to muster 53.

Senate Democrats criticized Mr. Myers for speeches over the years in which he often used the strong language of large ranchers and other Western landowners who maintain that they suffer oppression at the hands of federal environmental regulators. Mr. Myers once said, for example, that environmental regulations were akin to King George's tyranny over the American colonies....

RE: 9th U.S. Circuit Court of Appeals

This Californian wants to thank you profusely for your part in blocking the confirmation of William Myers for the 9th Circuit Court of Appeals. The potential environmental damage he could cause with such a lifetime appointment is painful to contemplate.

Although GW Bush has managed to appoint a myriad of extremist jurists during his term, I rejoice that 7 of them have not made it through. Kudos to you and our fellow Democrats for making at least that much possible.
