Rep. Bob Ney introduces bill to never change election dates |

This has just been introduced, I will let you know more as I find out. WASHINGTON D.C. – U.S. Rep. Bob Ney, Chairman of the Committee on House Administration, announced today that he will introduce a House resolution tomorrow expressing the Sense of the House that our national elections will never be postponed in the face of terrorist threats or attacks, nor will any individual or agency be given the authority to postpone the date of a Presidential election. More than 65 House Members have already signed on to be original co-sponsors to Chairman Ney’s resolution. H.RES.728 Title: Expressing the sense of the House of Representatives that the actions of terrorists will never cause the date of any Presidential election to be postponed and that no single individual or agency should be given the authority to postpone the date of a Presidential election.

CONCURRENT RESOLUTION
Expressing the sense of Congress that the Federal Government should not give any Federal agency the power to postpone the date of Federal elections.
Whereas Election Assistance Commission Chairman DeForest Soaries has proposed a policy for allowing the alteration of the schedule for Federal elections in the event of an unspecified emergency;
Whereas the United States has never postponed or delayed a Federal election for any reason, even during the Civil War;
Whereas Condoleeza Rice, the Assistant to the President for National Security Affairs, has stated that the Administration has no intention of altering the schedule for Federal elections and expects the elections to occur as scheduled;
Whereas the American people have a longstanding and legitimate expectation that regularly scheduled Federal elections will continue to be held in accordance with Federal law; and
Whereas keeping the schedule for Federal elections is necessary to maintain confidence in the legitimacy of the Presidency and Congress both in the United States and around the world: Now, therefore, be it
Resolved by the House of Representatives (the Senate concurring), That it is the sense of Congress that—
(1) the Federal Government should not give any Federal agency the power to postpone the date of Federal elections; and
(2) the Secretary of Homeland Security should not act on the proposal submitted by Election Assistance Commission Chairman DeForest Soaries.

On edit: Perhaps the issues are related?
No postponing of the elections also means no making sure the voting systems (which 2239 protects) have paper trails and cannot be hacked?
I don't trust this guy as far as I can throw him.

But as I pointed out when this came up earlier, a resolution is not the same thing as a bill. It declares the "sense" of the body, but has no legal effect. It is not subject to veto.

It implies too much that could be used as precedent for some other centralizing, extra-legal measure ...
First, it asserts that no "Federal election" has ever been postponed. Of course not, since there is no such thing as a "Federal election."
Second, by citing what Rice has stated, there is an implied assumption that the executive branch of government would have the authority to delay or cancel elections if it chose to do so.
Third, the term "Federal elections" is repeated, and no mention is made of the fact elections should adhere to both federal *and* state laws, and it is the states that set the rules of their elections, keeping in mind what federal laws there are to regulate them.
Fourth, the problem mentioned in citing Rice is repeated in the first and second resolves.
In summary, I think this resolution is a wolf in sheep's clothing.

Ney is "up to his neck" in the BBV scandal. He's the Chairman of the committee that has been blocking Rush Holt's HR 2239. The bill for a paper trail. He never worried about our elections until his e-voting scam got exposed. I don't know what he's doing but it ain't good.:(

Why would they want this? Maybe because when terror elerts or terrorism happens in Democratic cities on election day, causing minimal or low turnout, there is no recourse to aid people in casting their vote or extending the voting to more than one day or whatever.
Don't trust these fucks.

I suspect this may be a maneuver by pubbies to backfill after the political damage that was done by the lead trial balloon last week. This will do nothing except make it appear that Republicans in Congress are against postponing elections. It won't prevent Bush from postponing elections.
