Bush campaign calls Kerry campaign complaint to FEC "frivolous"

President George W. Bush's re-election campaign launched a preemptive defense against a complaint by Democratic challenger John Kerry that a group attacking Kerry's Vietnam war record had illegal ties to the Bush campaign.

"The Commission is about to receive a frivolous complaint from Kerry- Edwards 2004, Inc.," Bush campaign general counsel Thomas Josefiak said in a letter to FEC Chairman Bradley Smith.

"This complaint should be promptly dismissed since, as the attached verified transcript demonstrates, Mr. Kerry's own spokesman, Tad Devine, could not present even one piece of hard evidence to back up the Kerry campaign's allegations." ..

The Bush-Cheney campaign flatly denies any coordination with Swiftboat Veterans for Truth," it said. "Furthermore, Mr Devine's own performance demonstrates that the Kerry-Edwards campaign also has no evidence of illegal coordination. The commission should ... dismiss this complaint immediately." ..

Well, they can't very well say that Kerry's complaint (which hasn't been filed yet) is worthy and correct. They'd have to admit wrongdoing if that was the case. Instead, the Bush campaign claims that the complaint is baseless and meritless without even having seen it. What, did the Kerry campaign hire the same lawyers Fox used when it sued Al Franken for his "fair and balanced" look at the lying liars Fox employs?

6. I wonder when that Devine interview was
because Cordier is one obvious link. BTW, I don't think anyone is under the illusion the FEC will do anything soon, but this gives Kerry's team the chance to present all the evidence together and make the case to the public.

From Federal Election Commission web site:
Filing a Complaint
If you believe a violation of the Federal campaign finance law has taken place, you may file a complaint with the Federal Election Commission. Send the Commission a letter explaining why you (the complainant) believe the law may have been violated, describe the specific facts and circumstances and name the individuals or organizations responsible (the respondents). Your complaint should also indicate which allegations are based on personal knowledge rather than on outside sources (for example, newspaper articles). The letter must be sworn to, signed and notarized. Complaints of alleged violations receive case numbers and are called MURs, Matters Under Review. (For more information on how to file a complaint, call the FEC.)
The Commission sends a copy of the complaint to the respondents, who have the opportunity to explain why the Commission should not pursue the complaint (for example, because no violation occurred or because there were mitigating factors). The agency considers the views of both sides and may conduct an investigation to gather facts. Until the MUR is resolved, the Commission must keep all phases of the proceedings confidential, as required by law. After it makes a decision, the agency notifies the complainant and the respondents. The file on the MUR is then made public.

So if they feel "no violation occured" or "there were other mitigating factors," the Bush campaign can try to make that case.

I'm sure they gathered their evidence carefully, methodically, and patiently waited until all was in gear before they filed.
Their reputations depend on this.
