Judge Finds Abortion Ban Unconstitutional
LINCOLN, Neb. -- A third federal judge ruled Wednesday that the Partial-Birth Abortion Ban Act is unconstitutional, saying it fails to include an exception when a woman's health is in danger.

U.S. District Judge Richard Kopf of Lincoln said that Congress ignored the most experienced doctors in determining that the banned procedure would never be necessary -- a finding he found "unreasonable."

"According to responsible medical opinion, there are times when the banned procedure is medically necessary to preserve the health of a woman and a respectful reading of the congressional record proves that point," Kopf wrote. "No reasonable and unbiased person could come to a different conclusion."

5. On the contrary. Message: elect Bush to appoint better judges.
They deliberately wrote the PBA law to be found unconstitutional, as they do with all abortion legislation, so they can make political hay over it.

Think about it. They have had the White House & House of Reps for four years and the Senate for two. If they really wanted to do something about abortion they could have done it by now.

4. What congress failed to see
is that PBA's are used almost exclusively in emergency situtations. Not too many doctors will do them on request.

7. I wonder how much tragedy has occurred due to this law
we have not heard or seen anything. I would say, according to what the judge said, that he thinks that George Bush is unreasonable and biased and he is not wrong.
