Appeal set for lawsuit seeking special election (McGreevey)
TRENTON, N.J.(AP) _ The 3rd U.S. Circuit Court of Appeals will hear arguments that a federal judge was wrong when he dismissed a lawsuit seeking a special election to replace Gov. James E. McGreevey, lawyers who filed the suit said Tuesday.

The court will hear arguments Oct. 7 in Philadelphia. A state Superior Court judge will hold a hearing Oct. 4 on a similar lawsuit.

U.S. District Judge Garrett E. Brown Jr. rejected the argument that McGreevey had effectively created a vacancy by saying he would step down on Nov. 15.

The governor has not left office, and there is no vacancy to fill by a special election, Brown said in his Sept. 15 ruling.

1. I think by NJ law there can't be a special election this fall !
Sept. 15 was the deadline.

3. What merit does their claim have
against McGreevey? I mean we all know he went public with his affair but seriously he wasn't impeached. His resignation date could be set anytime he wanted. If the NJ legislature was that worried about getting a special election, then they would have impeached him before the deadline.
