If Electoral College Fails, Dumbya remains in office! One near-certainty in this election of many uncertainties is that if the Electoral College (news - web sites) can't pick a winner, George W. Bush will stay in the White House. The New Representatives would not take office until January. Who would decide then? The old Repub House or the new Dem House? ??

It would be the new House of Representatives, and while it's not out of the question to win it back, it'd be very, very difficult.

According to Amendment 12, the House votes state-by-state. Wyoming delegation thus has as much voting power as New York or California.

If the electoral college fails, it would only be logical to then look at the popular vote. If the popular vote were then magically a tie (what are the odds?), then I would understand the need to send it to the HoR. Why were our founders so quick to jump from electoral college to HoR, skipping the middlemen (the people's true vote)? (Don't answer that, it was just a rhetorical question.)

...and please correct me if I am, but doesn't the house vote by state delegation instead of by individual member? If this is indeed the case I don't know who would win. Perhaps one of you does.
