Miss Universe Law Suit is just another chapter in a harassment campaign against The Miss Mexico Organization (MMO), which started almost three years ago, in an attempt to get the Latin company to withdraw an Application for SEÑORITA MEXICO USA trademark, which is still under litigation before The U. S Trademark Trail and Appeal Board (USPTO). Miss Universe position is
that they do not want the acronym “USA” to be used in connection with any beauty pageant, because according to them, this would constitute an infringement of their marks. they have not been able to prove that before the USPTO. It is important to mention that there other beauty pageants using the same composition: Miss Brazil USA, Miss Vietnam USA, and Señorita Colombia USA which even got theirs registered at the USPTO, and others, none of which are being sued nor harassed, as far as it is known. This seems highly discriminatory.

On March 5th, 2008, after a long three years litigation process, the USPTO ‘s appeals board decided that the registration for the SEÑORITA MEXICO USA would not generate any consumer confusion, therefore Miss Universe motion was denied. Following The USPTO’s resolution on March 5th which states that Miss Universe motion for summary judgment had been denied, Miss Universe filed a complaint with The U.S Federal District Court in Nevada on March 18th, 2008 against Adan S. Perez, Luz S. Bolivar and The Miss Mexico Organization which main objective is to intimidate The Señorita Mexico pageant organizers to get them to abandon the application for the Trademark Señorita Mexico USA.

Among the absurd excuses for the lawsuit, were pictures placed in their website www.senoritamexico.net, where Mr. Trump and the titleholders were voluntarily posing with people of their organization, during the Miss Universe contest in Los Angeles on June 2005. These pictures were posted inside an Activity Gallery where images with celebrities are situated in different events they attend as part of knowledge enrichment activities. There was also a complaint about an image of a Miss Universe’s crown which was according to Adan unintentionally placed in the website. “He didn’t t have to shout so loud, we didn’t know that crown was Miss Universe’s, a “cease and desist” letter would have been enough to remove any unwanted images” said Adan Perez. “Filing a Lawsuit with the courts for the pictures in the website is an extreme action, which clearly states an intimidating strategy in order to get us to abandon the application for the mark.”, Adan continued, “Using the situation with the pictures and the unintentionally posted crown, to say that we were somehow trying to imply that they are in some way associated with us, is absurd”, “You will have to be very naïve to think that Miss Universe has to do something with a pageant in which ethnicity is a qualifying factor” Said Adan. “I think this action is just trying to get a lot of publicity for his upcoming event, coincidentally coming to Vegas”.

In order to accomplish this objective, in their complaint they request the court to sustain their oposition at the USPTO with regards to the mark SEÑORITA MEXICO USA, even thought the Federal agency has already denied their motion. Compared to David and Goliath, It was a great defeat for Miss Universe that Adam Perez, a self represented Paralegal who by strict conviction of being on the right side, is successfully confronting the greedy giant and their huge team of Lawyers.

It looks like Mr. Trrumo has a great interest to prevent them from carrying out the Mexican national beauty pageant in the USA, andhe will use all of their power and money to monopolize the beauty pageant industry, not allowing other people to work on their own unique ideas.
