Justice Anthony Kennedy on C-SPAN |

This is really worth listening to. He's blasting mandatory sentencing, comparing US incarceration rates with European rates, addressing minority over representation in the prison systems, quoting Stephen Bryor, etc. First his wording in the Lawrence case, now this. I'm beginning to like him.

He later said that he voted that way because the Republicans were willing to tear the country apart over it (as if that's a surprise) and the Democrats weren't. He was influenced in this thinking by the "protester" thugs that went down to intimidate and try to stop the recount in Miami.
I wonder if he regrets his vote now.

that the recent decisions on anti-sodomy laws and the U of M affirmative action were meant to send a message to bushco of his regrets. also, the fact that some justices were speculated to retire during shrubs admin but have yet to do so tells me that most of them realize just how dangerous this guy is.
