Bush in response to defeat of FMA:

"Activist judges and local officials in some parts of the country are not letting up in their efforts to redefine marriage for the rest of America and neither should defenders of traditional marriage flag in their efforts," he added.


Who are these wild-eyed,liberal activist judges?

"Most judges accused of being "activist" were appointed by conservatives. That's hardly news to regular morons.org readers, but it's information Lambda Legal seeks to disseminate to the public as it launches a campaign to dispel the "activist judge" myth that right-wingers so love to propagate. Their study of court rulings that favored civil equality for gays revealed:

Six of the seven judges responsible for the Massachusetts gay marriage ruling were appointed by Republicans.

Four of the six Supreme Court justices who sided with the majority in Lawrence v Texas were appointed by Republican presidents.

The Orange County judge who ruled in favor of a GSA in 2000 typically makes decisions characteristic of a conservative judge

The New York judge who ruled a gay man could sue a hospital for the wrongful death of his partner also typically makes conservative decisions

2. Brown v Board of Education
and Roe v Wade. They forget that there are three branches of government. The U.S. Constitution is an impediment to their way of life. It makes it hard for them to achieve their vision of a racist corporatist theocracy.

6. Activist judges
Here in Massachusetts, in 2006, we most likely will be voting as to whether to amend the state constitution to outlaw gay marriage and establish civil unions. Polls show the electorate split pretty evenly on the issue.

So what happens if we vote to keep gay marriage? Can they still blame the activist judges then?

Just watch and keep count. Heck, it could be a good GOP Drinking Game - one chug for every time you hear one of them say it in a 3-hour period or something.

I remember when that miserable, sanctimonious Colorado congresswoman Marilyn Musgrave was on Larry King, talking about this several weeks ago. She was on against the Gavin Newsom - San Francisco mayor, about the gay marriage license issuance. And MAN, if I had a nickel for every time she said "activist judges" I coulda retired all over again. It's NEVER defined. It's NEVER explained. It's just blathered out like a constant seasoning of a rancid stew - if they just keep on adding salt, you'll just taste the salt, not the spoil it's meant to cover up.

By the way, the lovely Musgrave also insisted that gay marriage would lead to bestiality and polygamy because, well, Jesus, Mary and Joseph, there's just no telling WHERE this debauchery will lead!

"Activist Judges" is just a buzz phrase. A talking point for the intellectually lazy reactionary. Designed to provoke and score a cheap point without having to break a sweat. And the reason they plug it in like so many plug-in air fresheners all over a stinky house is because it sounds good, newt gingrich has already test-marketed it for effectiveness, and they can use it for free - without even getting into what they might even think it means. They can use it without having to think, period. Just pre-fab provocation.

8. those who made is ok for interracial marriages...forced the southern
states to accept and recognize them. The judges that ruled in favor of gay marriages. The judges who want fair and equal treatment for everyone.

The republican hatemongers use code so as to not have their bigotry be AS obvious.

States Rights was always a racist code, now it--along with activist judges--is used as anti-gay code.

The real activist judges in my mind are the Supreme Court that gave us this idiot of a President.

10. I stopped Gordon Smith's lackey on that point yesterday
I called Smith's office to register my disappointment that he was walking point for this meaningless, doomed piece of nonsense, and the nice fellow who answered the phone started yakking about "activist federal judges." I stopped him and asked, "Who? Which federal judges are you talking about? The case in Massachusetts was decided by the state supreme court."

He changed his wording in a big hurry, but continued to blather on about judges. If I'd had more time, I would have challenged him on which laws he thought the judges were violating, or if he thought the judges were following the laws as written.

Keep slicing away at their layers of bullshit. We can stop the buzzwords.
