13. No. But maybe prosecutors are smart enough to withold seperate
charges because they realize that this is likely, and try Lay on other charges after he is pardoned.

That's what I would do if I wanted to insure that justice is served, if this is a legal possibility.

Wanna Know What I think *should* be done to the guy?

Don't send him to prison. No, no, I'm not saying let him off.. Hear me out. Sending him to prison for 5, 10 years, he's still gonna get out, possibly have his health (because he won't be going to a poor people's prison, for instance) he won't have his hair, but he doesn't have that anyway, but.. most importantly, he's still going to have lots and lots of money... Stashed in Swiss bank accoutns, blind trusts, Van Goghs in the basement, that kind of thing. So here's my proposal.

Don't send him to jail. But take ALL his money. All of it. All the money, all the mutual funds, all the stuff, all the stocks, all the booty, all the bonds. All the three piece suits and the hummers and the gold-plated bathroom fixtures. Everything. (I can hear the conservative lurkers screeching in abject terrror, in the background.).. Then, instead of jail, sentence him to TEN YEARS working a shit minimum wage job, preferably something that involves wearing a paper hat and asking "would you like fries with that?". He's gotta show up, every day, and he's gotta live, pay rent, and support himself on that. No bailouts from his rich friends. And, probably, no health insurance.

I'm sure the reaction from the right would be: You can send him to jail- but you can't sentence him to being POOR! Why.. Why... That's Cruel and Unusual! And you know what? In Bush's America, 2004---- they're right.

17. You're exactly right - but it ain't ever going to happen.
Every one of the corporate thieves that have been caught have been able to keep most of the money. Charlie Keating, Marvin Warner, Michael Millikin, and on and on. They generally move to Florida (that place again) where state laws allow them to keep everything, even if they are legally bankrupt. O.J. lives there, as do most of the above. One other thing, in the ideal world that you describe, a fast food job for Kenny Boy isn't enough. He really needs a job like mining, construction, or farm work so he can find out what real work is.

8. Ken Lay was on Larry King
and told Larry that he asked for his trial to be first among the others that are being tried at the same time. My guess is he wants to go first so it will be over and he can be pardoned by Bush before Bush is beaten by Kerry.

10. Exactly..
... I don't think he can be pardoned until he is convicted. That is why the whole timing of his indictment is very suspicious. It's damn near perfect.

The only good thing I can hope for here is for some prosecutor or judge to delay the trial. I can dream can't I? :)

19. Ford gave Nixon a "pre-conviction" pardon.
Nixon hit the road two jumps ahead of the impeachment posse.
Ford gave him an all purpose Get Out Of Jail Free pardon.

14. Lay wants to be first so no one can drop a dime on him.....
He's afraid his shills might crack and spill the beans on how he knew EXACTLY what was going on. He wants a speedy trial (said so himself) before anyone else starts pinning the blame on him.

Once found innocent he can't be re-tried for the same crime.

11. It should be proportional to how much he stole. -
If a person gets a couple of years for stealing a car, worth say $20,000, then stealing 200 million should net 20,000 years. With time off for good behavior, he should be out in time to see the Red Sox win their next world series. But of course, Bush will not only pardon him, he will give him the medal of freedom and allow him to keep most of the loot.
