AAR: Shelby WON'T be prosecuted... It is an offense but the CHOICE WAS
made not to prosecute... Page A 16 in the Washington Post!!!

Just like Berger's infraction.....
Shelby's IS a criminal offense....

Federal investigators concluded that Sen. Richard C. Shelby (R-Ala.) divulged classified intercepted messages to the media when he was on the Senate Select Committee on Intelligence, according to sources familiar with the probe.

Specifically, Fox News chief political correspondent Carl Cameron confirmed to FBI investigators that Shelby verbally divulged the information to him during a June 19, 2002, interview, minutes after Shelby's committee had been given the information in a classified briefing, according to the sources, who declined to be identified because of the sensitive nature of the case.


Cameron did not air the material. Moments after Shelby spoke with Cameron, he met with CNN reporter Dana Bash, and about half an hour after that, CNN broadcast the material, the sources said. CNN cited "two congressional sources" in its report.

The FBI and the U.S. attorney's office pursued the case, and a grand jury was empaneled, but nobody has been charged with any crime. Last month it was revealed that the Justice Department had decided to forgo a criminal prosecution, at least for now, and turned the matter over to the Senate Ethics Committee.

The Justice Department declined to comment on why it was no longer pursuing the matter criminally. The Senate ethics panel also declined to comment on its investigation.

2. The question remains: Why did he leak this information? It is damning
of the Bu$h administration and supports Sibel Edmond's disclosure of deep corruption within our Intelligence system. If he were to be prosecuted, it could bring to public attention that our intelligence agencies have been deliberately compromised by the Bu$h administration:

U.S. intelligence agencies find themselves defending their abilities in the aftermath of the deadliest terrorist assault in the country's history. Sen. Richard C. Shelby (R-Ala.), vice chairman of the Senate Select Committee on Intelligence, said the incident demonstrates the need for a broader array of recruits familiar with other cultures and languages.

"If we had a warning and missed it, that is a failure of intelligence, big time," Shelby said after being briefed by Attorney General John D. Ashcroft and FBI Director Robert S. Mueller III. "If we didn't have any inkling of this event, as well-planned and well-executed as it became, that's a failure, too."

Shelby's office could not be reached for comment, but he has previously -- and vigorously -- denied involvement in any leaks.

In June 2002, CNN and other news organizations reported on messages intercepted by U.S. intelligence on September 10, 2001, that consisted of Arabic-language telephone conversations between people in Afghanistan and Saudi Arabia.

One of the intercepts said, "The match begins tomorrow." The other said, "Tomorrow is zero hour." The intercepts, however, were not translated and analyzed until September 12, the day after the attacks. Sources said the intercepts would have been studied within 48 hours, regardless of the attacks.

A joint House-Senate committee was holding closed-door hearings on the Sept. 11 attacks when CNN reported "congressional sources" as saying that intercepts were made on Sept. 10 that hinted at the impending terrorist attacks. However, the intercepts were not translated until Sept. 12.

Shelby, speaking to a small group at the Grove Hill Town Hall, noted that there were over 100 people in the room where the hearings were conducted.

What is important about the controversy, Shelby said, is that the National Security Agency did not translate the messages in a timely manner. Knowing what was said the day after the attacks was of little use, he explained.
