BBV : Question for researchers
Is Hava consistent with states rights? Is there a possible court challange ? If so.......what is the argument and if not what is the argument.

1. I think it is
HAVA doesn't "force" states to do anything. But if they don't follow HAVA, they don't get federal money.

The feds use this method all the time to get states to do what they want them to do.

2. OK, so Hava
is not really a "law" as some in the voting machine business and some Sec. of States, would have us believe. Right ?? How about the section that mandates changes to help the handicapped vote?

She argues that three violations of federal law take place when you vote on a machine.

1. An inability to observe if voting machines properly register vote

2. An inability to observe if voting machines properly count votes

3. An inability to enforce the Voting Rights Act, because of the inability to boserve if voting machines are properly registering or counting votes.

Discussion and opinions, please.

7. Those are excellent points
What we need is a benefactor to fund a court challenge to test these questions.

If somebody can find a foundation that would fund something like that, I'd be more than happy to write the grant application.

Hmmm, I dunno. Would have to read these documents. Too bad the author doesn't provide a link. What with these on-line writers/researchers? Give us links!!

9. HAVA and federal elections
Congress can make laws that require rules for any federal election. That is the hammer that they can use. Congress can require gold plated voting machines for any congressional election. Do you think states will spend their own money to have two different systems? No.

The compromised HAVA will be tested in court, just don't know when. Congressional staffers know this law will be tested in court because there are too many vague aspects to it. I imagine once states come up to different deadlines, the lawsuits will test it.

Once that happens there won't be any need for a court challenge--states'll drop those fuckers like a hot iron.
