URGENT REQUEST for DU election researchers
Hi all,
You're doing amazing work contributing hard background research to the recount effort. Can you please help out with Iowa now? The way Iowa's recount laws are written a recount request must be requested in writing to each county with 3 days of that COUNTY certifying their results. There are 90+ counties in Iowa. We need to find out when each county certified their results. The names of the counties should be on the Secretary of State's site. The certification dates should be at the county websites individually.

No one person should be doing all of them, so could someone please cut and paste the list of counties from the Iowa site and people each volunteer on this thread to check out 5 specific counties at a time, get the info for your batch and post it here.

We only need the name and certification date each county. Nothing more.

This research has to be done no later than tomorrow (sat) morning.

I'm PMing Eloriel to monitor and guide this thread. Please contact her with questions.

It lists the following:

Fri., Nov. 12 RECOUNT DEADLINE.
Three days following the county canvass of votes is the deadline for
recount requests to be filed in the office of the County Auditor.

Statute cited: 50.48(1)

I read on a general website table (which I posted elsewhere on DU in response to a research request last week about certification deadlines)--that in Iowa the Contest "depends on the type of election"--so does that mean that the November 15th deadline (3 days after county canvassing deadline) for recounts applies to contests OTHER than the general election? And does it further mean that the results of the general election can be contested after the November 29th deadline for statewide canvassing? Someone with legal background needs to clarify this with the Secretary of State or Attorney General in Iowa.


But I think the answer is in the Auditor's calendar.

Who has info or insight to refute this idea? Anyone care to look up the relevent statute? (I'm totally braindead right now myself -- having trouble figuring out how to make an m into a comma -- THAT's pretty bad.)

11. Is the Nov. 29 date for all counties?
I have been looking, but individual county sites seem to be nothing more than tourist info.

I will help if someone can point me in right direction. Sorry, I am ignorant about this, but will do my best. Help please?

Only dates I see are voter registration deadlines.

The only other date I've seen is that November 29 (Monday) date.

I have not found one that says when they were/will be certified. To make matters worse they are closed until Monday.

for all county canvasses to be complete, after which there were 3 days to file for a recount. Iowa election code 50.48 (1)

The STATE CANVASS deadline is November 29th. The Iowa election code is 50.39.

27. OK, after a look at the counties websites,
I can't find anything to suggest the date they will be individually certifying their results. It seems like an impossible request. Phone calls will surely be necessary if they are indeed certifying their results at different dates and those dates aren't in some database of some kind.

Let me know if I should keep at it or not...

the county canvass was held on Monday or Tuesday, November 8 or 9.

But does tne recount deadline here apply to the general election? Not sure, I'll keep looking. But it sure seems like a ridiculously short time frame for a presidential election...

33. Since I was not yet sure if the deadline had passed
...I decided to check into the 2000 election when the GOP was considering a recount in Iowa. I found an archived CNN article that clearly stated they had three days from when the counties finished certifying.

Using 2000's General election as a guide the deadline has already passed.

DES MOINES, Iowa The votes are in from Iowa's 99 counties.

Election officials say the results from the November second election have arrived at Secretary of State Chet Culver's office.

They were all in by yesterday afternoon. Culver had asked the counties to get them in by last Friday, but some counties were late.

Spokeswoman Phyllis Peters the votes will be compiled and rechecked. The totals will be certified on November 29th.

“50.50 Administrative recounts.

The commissioner who was responsible for conducting an election may request an administrative recount when the commissioner suspects that voting equipment used in the election malfunctioned or that programming errors may have affected the outcome of the election, of if the precinct election officials report counting errors to the commissioner after the conclusion of the canvass of votes in the precinct. An administrative recount shall be conducted by the board of the special precinct established by section 53.23. Bond shall not be required for an administrative recount. The state commissioner may adopt rules for administrative recounts.
If the recount board finds that there is an error in the programming of any voting equipment which may have affected the outcome of the election for any office or public measure on the ballot, the recount board shall describe the errors in its report to the commissioner. The commissioner shall notify the board of supervisors. The supervisors shall determine whether to order an administrative recount for any or all of the offices and public measures on the ballot.”


Please note also that 52.38 requires that “All portable tabulating devices shall be tested before any election in which they are to be used following the procedure in section 52.35, subsection2. Testing shall be completed not later than twelve hours before the opeing of the polls on the morning of the election. For any election to fill a partisan office, the chairperson of each political party shall be notified in writing of the time the dcevices will be tested so that the chairperson or a representative may be present…” and also describes the form to be signed certifying that the machines were zeroed, locked, and sealed.
