The way in which most spammers operate borders on illegal if not outright breaks the law.
The means by which spam makes money is dependent on the low cost of distribution vs the profits made by hooking a few customers in the millions attacked. The distribution method becomes the problem. Most ISPs do not allow spammers on their nets so alternate means have to be found. Thus they turn to hacking into unsecured email servers and having them do all the work.
Most spam is untracable because they have bounced it off someones unsecured server or infected someones PC with a virus that sets up a spam engine. It then does all their dirty work and they collect the profits while you pay the price of having your service cut off.
Its not illegal but if you are doing it expect to get a call from your ISP right after your connection dies.

They broke laws about destroying the trail making them untracable. Not about distribution of bulk email.
