BRIAN L. BUCKLEY <#116705>, 48, of Los Angeles was suspended for one year, stayed, actually suspended for 30 days and until the State Bar Court grants a motion to terminate the suspension, and he was ordered to take the MPRE. If the suspension exceeds 90 days, he must comply with rule 955; if it exceeds two years, he must prove his rehabilitation. The order took effect March 2, 2003.

In a default proceeding, the bar court found that Buckley failed to perform competently, communicate with a client or promptly return a client file.

He represented a client in a wrongful termination lawsuit that settled for $600,000. One quarter was to be attorney fees. Fowler agreed to dismiss the suit after full satisfaction of payment, which was to be delivered in installments.

Once Buckley received his fee, he was to execute the necessary documents so the remaining payments would go directly to his client's family attorney. However, he did not do so, and instead continued to receive settlement checks without notifying his client. He eventually delivered 20 checks to his client, but one bounced.

Buckley received four final installments without notifying the client, dismissed the lawsuit before the client was paid, and waited another year to give the client the full settlement.

He did not return his client's numerous phone calls or release his file to the client's new lawyer. After several months, he provided a portion of the file to the other attorney.

The bar also found in another matter involving Buckley, Case No. 02-O-10118:

"By failing to inform the Gonzaleses of the true status of their legal matters and actively misrepresenting the status of their legal matters, by misappropriating $5000 in costs paid by the Gonzaleses to for the cost of the Discovery Referee and depositions, and byy repeatedly taking <$8000> monthly fees from the Gonzaleses while doint no substantive work of value to the Gonzaleses durinig the time period he received the legal fees, comitted acts of moral turpitude, dishonesty or corruption in violation of Business and Professions Code sectioon 6106.

They also got him on failure to refund the four months of unearned fees, failure to inform client of significant development and failure to preform with competence.

"In the nine month period from September 2000 to May 2001, the Gonzaleses paid $94,857.00 . . . "

"Ultimately, the Gonzaleses lost both lawsuits and have been ordered to pay $160,906.00 . . . "

"The Gonzaleses called Respondent at his telephoone number he provided to obtain an explanation of the judgment. When confronted by the Gonzaleses, Respondent told his clients that it was all a mistake. He denied the existance of the judgment, and that the matter had been dismissed based on the Tribune's motion. The Gonzaleses asked for proof of Respondents representations, to which Respondent said that all the paperwork had mistakenly been taken by an unidentified Federal Agency whho raided his office because theh person who rented space from him had stolen $3,000,000.00 from a client."

Accusers and defenders of President Clinton descended on Washington yesterday, holding simultaneous protests on the weekend before midterm elections and addressing the scandal that has consumed the capital since January.

The anti-Clinton forces, gathered on the grounds of the Washington Monument, drew a much larger following as several thousand people apparently heeded the call sent out on the Internet just three weeks ago. The showing delighted organizers, who estimated the turnout at 4,000 and said the cyberspace cry for political action set a new standard for grass-roots organizing.

"It's a remarkable thing," said Brian L. Buckley, counsel for the Web site and for its founder, Robinson. "I don't think anything like this has ever happened before, where thousands of people who didn't know each other get together in a place thousands of miles from home," he said of the Internet's ability to politically connect people.

"We in America are not going to stand for this. Impeach him, indict him, try him and send him to Leavenworth," Robinson said. To the delight of the overwhelmingly white crowd, he paraphrased Clinton's now famous denial of an affair with Monica S. Lewinsky: "I want to point my ugly finger at him. Mr. President, I never believed you. Not once. I never did and I never will."

Many people at the rally knew each other only by their online identities, and that lent the event an almost surreal air. "Captain Rick? Okay," one woman said to a man with whom she had spent a few minutes chatting. "I'm Spart. S-P-A-R-T." Buckley knew the press coordinator only by his online name, and the two had not even met until Friday night. The coordinator, for his part, preferred the anonymity. He said he worked in Hollywood and did not want his name publicized.

Hi Tinoire! :hi: Glad we are having a Tinoire Reunion! I saw a couple of posts of yours earlier and thought "wow, where has Tinoire been...haven't seen you around for quite awhile....Have you been lurking or taking a hiatus?

It's the same DU, just a little more edgy these days, lots of cases of depression and ofcourse a lot more Freepers infiltrating, but other than that, we are all here...especially us late nighter's who can't sleep....

It's good to be back :) Unfortunately my new job keeps stats on web usage so I dare not spend hours researching the way I used to and keeping on top of things.

I took a hiatus but did lurk quite a bit. You know DU- once you get it in your blood, you never overcome the addiction ;)

The Freeper infiltration is one reason I decided to come back... The frustration of being an old loyal and wondering "My God, did anyone hit the alert button on this creep?"

As most of you know, Free Republic is engaged in a life and death struggle with elements of the socialist propaganda machine, namely, the Los Angeles Times and the Washington Post, over whether or not the First Amendment guarantees our rights to gather in our electronic townhall forum where we virtually pass around newspaper clippings of news accounts of government abuse and or unconstitutional expansion, for discussion and critiquing purposes.
The LAT/WP has brought suit against us in federal court for alleged copyright infringement and unfair competition. The trial judge in the case erroneously disallowed our fair use and first amendment defenses, basing her ruling on the false assumption that Free Republic is a commercial enterprise. We have appealed to the Ninth Circuit Court of Appeals where we hope to prevail.

We have just filed our final reply brief in this appeal. Looks like Brian Buckley and his crew have done a terrific job in presenting our case. If all goes as expected, we believe that oral arguments will be heard in September.
