Memo to Kerik: get a new lawyer |

Joe Topocina, Bernie Kerik's lawyer, was on "Imus" just now. He delivered an extraordinarily unpersuasive brief on behalf of his client. The essence of his defense was that Kerik has proved himself an authentic American hero, so to tar him now is unfair.
If my life were hanging in the balance and I had the resources Kerik appears to have, Mr. Topocina would not be my choice.

It may be "unfair" that he is subject to prosecution and penalty as the rest of the unannointed, but that subjective assessment is irrelevant. "Unfair" won't give you a free pass.
Is that the best legal argument he can come up with?
