NEW YORK - A former state senator released after serving about three months of a one-year sentence in a bribery scheme must return to jail, an appeals court ruled Monday.
A five-judge panel of the State Supreme Court's Appellate Division unanimously upheld a lower court ruling that Guy Velella, a powerful Republican politician for almost 30 years, must return to jail Dec. 27.
The controversy over Velella's release started after the Department of Investigation and the Manhattan district attorney began an inquiry into possible criminal wrongdoing in the commission's granting him early freedom.
Last month the department issued a report stating the city agency had violated state law and its own rules in voting to release Velella and the others.
