SAME-SEX MARRIAGE -- Lawyer says gays are 'unfit'
SAME-SEX MARRIAGE -- Lawyer says gays are 'unfit'
Bob Egelko, Chronicle Staff Writer -- Friday, December 24, 2004
http://sfgate.com/cgi-bin/article.cgi?f=/c/a/2004/12/24/BAGEEAGK9K1.DTL

The future of same-sex marriage in California was left in the hands of a San Francisco Superior Court judge Thursday after a conservative group closed two days of hearings by arguing that gays and lesbians were inherently unfit for marriage.

"They can't perform the basic functions of marriage,'' said Rena Lindevaldsen, an attorney for the Campaign for California Families. "There is a basic difference between opposite-sex and same-sex couples ... the ability to procreate and, therefore, insure the existence and survival of our species. ''

<----snip---->

Limiting marriage to opposite-sex couples who can raise their own biological children "brings stability to the society,'' said Glen Lavy, an Alliance Defense Fund lawyer representing the Proposition 22 Legal Defense and Education Fund.

============================

If the brunt of the argument is procreation -- then I propose:

1. couples seeking a marriage license must undergo fertility tests. Licenses will be denied if either are determined to be infertile or otherwise unable to produce children. Use of fertility clinics will be illegal as they interfer with the natural order of how God intended people to reproduce.

2. couples must sign an agreement to have a minimum number of children -- failure to do so within a specified time will result in an automatic repeal of their marriage license.

3. Couples past the "child-bearing" years will not be allowed to marry -- even if they have had children from a previous marriage. All marriages must be fertile and produce children.

4. If for any reason, (includes menopause or impotence), during the marriage, either of the spouses becomes unable to have children -- the marriage will be automatically dissolved.

5. Birth control will be illegal -- it interfers with the natural order of how God intended people to reproduce.

1. And I propose
Edited on Sat Dec-25-04 05:36 AM by Kurovski
that these crackpot lawyers are professional turd-traders.

They are worthy of zilch respect. They want to shell out contempt and cave-dweller logic and then hope to drape it in a black robe? Fuck 'em.

Of course your good list underscores how how shitheaded these moronic, worse than worthless "lawyers" actually are.

2. Limiting marriage to opposite-sex couples who can raise . . .
their own biological children is an insane position . . . does that mean that someone who is infertile can't marry? . . . that women past menopause can't marry? . . . should we take notarized statements from all couples wanting to marry that they won't become DINKs (Dual Income/No Kids)? . . . these people are nuts . . .

3. forgot to add
that viagra and other "sexual-performance enhancing" drugs will also be illegal -- if you can't get it up it must be God's will...

5. These people are pathetic...
and I guess my wife and I do not have a meaningful marriage, since her mom took DES when she was pregnant with her, and now we cannot procreate. These people have displayed their idiocy so effectively, that it makes me wonder why they should not have their professional credentials revoked.

6. the lawer is more blunt in the description
but that is the essence of conservative views on marriage.
however, one can feel the freudian undertones in this -- the images of gay sex that people like this carry around in their back pockets.

no reasonable 21 century person would be opposed to gay marriage -- now a person who thinks about avoiding same sex thoughts, emotions and sexuality every minute of their lives is going to have a very different reaction.

7. Don't forget...
Adoption would have to be outlawed too. Can't have little rat bastards that don't belong to anyone but their biological parents spoiling the "natural" order of things!

9. Well now that's going to get ugly, because
in the near future when Roe v Wade is overturned, and women are forced by law to complete every pregnency to term, where will all of the unwanted children go?

18. Of course you're right--I sometimes forget that soon there will...
only be jobs at WalMart or in the military. Maybe even WalMart can start using child labor right here at home instead of only overseas.

10. tell that lawyer that the bible is full of infertile couples miraculously
having babies. And that I'm sure if He wanted to, he'd slip a baby into me or my same sex GF. Godnoze we keep having sex, so He's got plenty o' opportunity to do His thing. Next time the bible gets updated I'm sure it will be chockablock with gay couples having kids.

12. making up the rules as they go

Procreation has never been the brunt of the argument, it only is now that it suits the reli-fundies goals.

What's next, outlawing mariage of people who are infertile or who simply do not want kids?

14. That's a pretty sad set of rationales.....
I wasn't aware that the basic function of marriage was simply to procreate. I guess that kind of Nazi-thought goes along with the "mandate". I suppose that we also need to raise proper and conditioned children to feed the needs of the Reich. Raise large families, too. Just make sure that none of your children are born with a birth defect. They will need to be taken out of the gene pool to keep it "pure".

It's really pure-effing evil thinking.

15. Oh come on, let's go all the way
If we really want to do the Jesus thing, we better go all the way and limit marriage to once in a lifetime with no divorce, after all that is what that book of fairy tales dictates, right????

His narrow minded bigotry would NEVER even BEGIN to stand up in a civilized world where all are part of an effective society.

and see the light.

So gay folks are unfit to marry. I hope that discussion is limited to humans, if they think they can control homosexual human. then, what's next? Going after other animal forms which have homosexual behavior?

20. That's just horrifying
I find that I'm incapable of relating to people with these kinds of beliefs anymore. I feel endangered by them. They're not trying to protect marriage; they're trying to create a special class of people and create additional difficulty for those they would exclude.

The basic function of marriage is to suck people into the economic machine and keep them in it. Period. It's not special. It's not even fun for most people, if they're honest, and above all, it's not necessary.

Think about it. You either love somebody or you don't. You're either a dependable, working partner or you're not. You're faithful or you're not. You either feel obligated to provide for your kids and take care of them or you don't. It's that simple. And people who are willing to spend time and money trying to pass laws that say this unnecessary "institution" - this idea, this piece of paper that costs money - is special and limited to certain kinds of people, the majority of whom will only use and cheat on each other, instead of trying to fix real problems and take care of people scare the bejeebers out of me!

21. Well that arguement doesn't hold much weight...
.. when you consider that there are 6 billion people in the world. I think these people will just think of any possible excuse to discriminate against gays. Kind of reminds me of that old song "Do you know what the queers are doing to the soil?" or something like that.

22. I hope the judge is married and CHOSE to not have children
in his/her marriage. That would be a wonderful outcome to personalize the stupidity of those lawyers' arguments.

Since I chose to never have children, I suppose I shouldn't be allowed to take up space on the planet . . .

We are not Condors or Spotted owls, there are plenty of human beings on this planet. Too much procreation is the problem. Too bad his parents did not practice birth control.
