Have the Pundit's caught the "and Elsewhere" loophole in the 9/7 Speech?
http://www.whitehouse.gov/news/releases/2003/09/20030907-1.html (About 2/3 way through if you can stomach it)

"The request will cover ongoing military and intelligence operations in Iraq, Afghanistan and elsewhere..."

Elsewhere is the whole frickin universe! Talk about a loophole. Amazing.

It completely negates even mentioning Iraq and Afghanistan.
