I think he's really planning on the ghost defense... he wasn't around when all the shit went down, and he doesn't know anything, and if he sticks to that story, the real story (and the investigators) will go away.
If he's hoping for the statutes to run out, I think prosecutors still have a couple of years to bring charges before a grand jury. If they don't, the charges die and they would have to start all over again. Maybe he's counting on that, but I hope prosecutors are thinking differently.
Last I heard, his lawyers were "negotiating" with prosecutors about which of his papers were personal and which were corporate.

However, lawyers for co-defendants Jeff Skilling & Richard Causey want a delay. Their appointment books are just too full for anything earlier than September--December would be even better. Lawyers & prosecutors will meet in court next week to discuss everybody's schedules; perhaps the judge will make his feelings known.

Skilling and Causey are accused of more than 30 crimes, including counts of fraud and conspiracy. Lay is set to be tried with his two colleagues on seven counts that relate to Enron fraud. But Lay will be tried separately on four other bank fraud counts that relate to his personal banking.
