Hahahaha "Jeff Gannon" is considering suing us all! |
|
Edited on Sun Feb-20-05 04:35 PM by Bluebear
Jeff Gannon is considering suing liberal interest groups, bloggers and others for a "political assassination" that drove him from his job as a reporter for a conservative news outfit called Talon News, he told NEWSWEEK. Gannon, whose real name is James Guckert, singled out Media Matters -- a "well-funded" liberal group headed by longtime "attack dog" David Brock. ("Everything we wrote about him came from the public record," Brock replied.)
It remains unclear how Gannon got routine White House press access for nearly two years; he acknowledged he first began getting clearance to White House press briefings in early 2003 as a representative of GOPUSA, a group headed by Texas GOP activist Bobby Eberle-months before Eberle even created Talon News. Gannon said he had no access to White House aides outside the press room, nor did he try to interview any. When President Bush called on him at a press conference last month-during which he asked a question with false info about Sen. Harry Reid-"nobody was more surprised than myself," said Gannon.
Hahaha go ahead "Jeff", sue for "political assassination". Can you see the trial?
Bailiff: The plaintiff calls DemoFla, please raise your right modem...DemoFla, do you swear...
(Nancy Grace whispers offscreen: "DemoFla is being deposed, and Gannon plans on calling KellyInVegas next, this could be devastating...)

Hmmm...think of all the juicy hate radio & TV people we could bring forward and have them explain, under oath, thanks to "Jeff", how they justify the lies they spew.

I wouldn't be surprised if something nasty came about by all this. Nasty against bloggers, that is - Pat Act may have some fine print in it about defending the Gannons of the propanganda world.
so I'm keeping my LOLs on this issue canned for the meantime. I've heard too much that should have ousted the Bushits but nothing comes of it.

"Political assasination"? Cant see him winning on that.
I hear his lawyer talking. When Gannon loses, his lawyer will have still to get paid, costing him alot of money.

As one of the comedians on the "Blue Collar Comedy Tour" said, one time after police were called when he was thrown out of a bar for being drunk, "I had the right to remain silent -- I just didn't have the ability!"
Jeff, every time you open your mouth or show up on another show to defend your integrity (!), you just keep alive the issue of how a male whore got access to the president.
From a legal standpoint, if he brings a civil lawsuit his attorneys will be able to take depositions (i.e., testimony under oath) of pretty much anyone they want. Wouldn't that be a trip!

25. No one forced him to do anything |
|
No one (of us anyway) forced him to build those sites and lend/lease himself out for money.
No one (of us anyway) forced him to gain access to the WH press corp and then to ask totally outrageous questions that drew attention to him.
No one (of us anyway) forced him to quit his shame of a job (was he being paid? Now they are looking for "volunteers" instead?) and go on publicly accessible tv programs to discuss his most embrassing past.
We didn't make him do any of those things. Nothing to sue anyone for.
That seems like a "frivious lawsuit" to me.

He had talked about talking to lawyers, and the guy at this point has no career, little money, plenty of time on his hands, and several conservative lawyers (yeah, another self-hating group) to likely represent him for free.

37. I can assure you that Gannon will never bring any such claim |
|
For one, it would give the defendants the court's power, discovery, to compel disclosure of even more embarassing facts from his sordid past.
Second, he doesn't even have a cognizable claim of which I am aware. Defamation won't work because he's a public figure, thereby invoking the NYT v. Sullivan actual malice standard. Actual malice actually doesn't relate to intent, as it would seem; rather, it means knowledge of falsity or reckless disregard of truth or falsity. In this case, that certainly wouldn't work since IT'S ALL TRUE. Most states have invasion of privacy torts, although the specific types recognize vary significantly from state to state. The one most closely approaching the type of claim he would need is "public disclosure of private facts," and there's at least one fatal obstacle to such a claim: just like defamation, the tort of disclosure is subject to serious constitutional restraints, not the least of which is that no one can be penalized for publishing information that is public.
