Screwing Americans, one law at a time ...

Bill Frist: The Soft-Spoken Doctor with Ice in His Veins
Senate Majority leader Bill Frist (R-TN) was a guest today (February 9, 2005) on Your World w/Neil Cavuto. Frist was on talk about the "tort reform" bill which Frist said will pass the Senate tomorrow.

Naturally, Frist made the bill sound like it was crafted solely for the purpose of protecting "the people." He said it will bring "overall equity or fairness to the system," and prevent lawyers from "channeling" suits to friendly courts.

He said in many cases Plaintiffs receive "maybe just a little coupon" while lawyers "take the lion's share." He said they want to make sure "the people who get hurt get the money."

During their discussion Cavuto asked Frist whether or not, given that Frist is a medical doctor, he worries that it looks like he's just trying to "protect his own?" Surprise, surprise, Frist said "no."

Comment: There was a whole lot more Cavuto could have asked Frist, including the most important question which is why he doesn't recuse himself from all involvement with this bill, including voting on it. Having Frist talk about tort reform is akin to the fox guarding the hen house. Here's an excellent article about Frist from LAWeekly, which says, in part:

Frist was born rich, and got richer — thanks to massive criminal fraud by the family business. The basis of the Frist family fortune is HCA Inc. (Hospital Corporation of America), the largest for-profit hospital chain in the country, which was founded by Frist’s father and brother. And, just as Karl Rove was engineering the scuttling of Trent Lott and the elevation of Frist, the Bush Justice Department suddenly ended a near-decadelong federal investigation into how HCA for years had defrauded Medicaid, Medicare and Tricare (the federal program that covers the military and their families), giving the greedy health-care behemoth’s executives a sweetheart settlement that kept them out of the can.

The government’s case was that HCA kept two sets of books and fraudulently overbilled the government. The deal meant that HCA agreed to pay the government $631 million for its lucrative scams — which, on top of previous fines, brought the total government penalties against the health-care conglomerate to a whopping $1.7 billion, the largest fraud settlement in history, breaking the old record set by Drexel Burnham.

The deal also meant that HCA can continue to participate in Medicare. And, as part of the Bushies’ deal shutting down what Deputy Assistant FBI Director Thomas Kubic called "one of the FBI’s highest-priority white-collar crime investigations," no criminal charges were brought against the top HCA execs who presided over the illegal bilking of federal programs designed to aid the poor — and that includes Senator Frist’s brother, Thomas, HCA’s former CEO (and current director), who’s been described by Forbes magazine as "one of the richest men in America," with a personal fortune estimated at close to $2 billion.

What did HCA do? It inflated its expenses and billed the government for the overrun; it billed the government for services ineligible for reimbursement (like advertising and marketing costs). HCA violated both law and medical ethics when, as Forbes put it, "the company increased Medicare billings by exaggerating the seriousness of the illnesses they were treating. It also granted doctors partnerships in company hospitals as a kickback for the doctors’ referring patients to HCA. In addition, it gave doctors ‘loans’ that were never expected to be paid back, free rent, free office furniture — and free drugs from hospital pharmacies."

This was something discussed over at MyDD regarding a comment by Mark Crispin Miller:
Hypocrisy is defined as "an expression of agreement that is not supported by real conviction," (Princeton University). Well, no one better personaifies hypocrisy than Senator Bill Frist, MD of Tennessee.

As we all know, Republican Senator Frist, MD is the majority leader in the Senate. He led the failed movement in the Senate to amend the Constituion in order to ban gay marriage. The party in which he leads has made it very clear what their stance is on the two issues of abortion and gay marriage rights. They are against funding institutions that perform abortions, and are against allowing homosexuals the right to marry and receive benefits as a result of marriage.

But did you also know that Senator Frist, MD, gets money from abortions provided at hospitals he OWNS and that those very same for-profit hospitals are now PROVIDING BENEFITS for same-sex domestic partners?

10. Once again
it's proven the republicans are hypocrites. I can't stand he's one of my senators. Ugh. I hope we can get rid of him in 2006 with Ford junior. Even if it's Corker I'd be happy (he has called Frist a "cat killer" so :shrug: and he's not a bad mayor). Anything to get rid of Frist!

4. Other than being related, was Sen/ Frist actually part of this
HCA? The article doesn't mention him, just his Brother, and I assume his Father since he was one of the founders.

If Sen. Frist WAS part of this mess, that's wonderful information to hang onto since rumor has it he wants to run for Pres in 2008!!!

review his financial statements at http://www.opensecrets.org
the info is there ...

in more recent financial filings, the HCA stock has been buried ... probably in the multiple trust funds he listed in his most recent statement ... trusts up the ying yang ... he has investments in companies who do the investing for him ...

but, go to the 1996 financial statement ...

I visited 3 pages of it, and found HCA stock listed multiple times.

For example,

on page 4, Item 9 w/a value between $5 and $25 million
on page 5, Items 8 and 10, with one in the $1 to $5 million range
on page 6, Items 2, 7, 9
I didn't go any further

the minimum he could do is recuse himself from bills involving healthcare, medicare, etc.

former IL Sen. Fitgerald whose family is in the banking business recused himself from the 2001 vote on the Bankruptcy Bill (which passed, but never sent to the WH for signature ... but, it's back again) ...

14. In the will isn't good enough. We need to find that he was actually
part of the illegal billings. Since he is a heart doctor, I assume he practiced at one of these hospitals associated with this group, and also was party to the illegal billing.

I wan't dirt on this guy BEFORE he decides he's running in 2008.

Being related, or in the will isn't good enough. I didn't condem Jimmy Carter for his brother Billy, and I didn't condem Bill Clinton for his brother either. I won't condem Frist for his relatives either. I do however believe Frist was a real part of this group and has very dirty hands.

How can we find out?

6. Not just the poor will be affected
by the bankruptcy "reform", but the middle-class as well, since most middle-class families file bankruptcy due to overwhelming medical bills that have devastated them. One serious illness and they could lose everything to the ever-greedier for-profit health-care system, their house, assets, income, everything. Sickening and disgusting. And it's only going to get worse before it gets better, if it ever does.

8. Neil Cavuto (Fox) was interviewing Charlie Jarvis today.
Neil was NOT towing the party line - but actually sparring with Jarvis over his trashing of AARP. In view of what you said, maybe I should give Cavuto credit for at least having a brain (and maybe even a conscience). Watch out Neil - Rupert may be watching!
