Delay's threats are a FEDERAL CRIMINAL VIOLATION OF US CODE!!!!

The Honorable Sen. Lautenberg wrote him a letter about it:

You should be aware that your comments yesterday may violate a Federal criminal statute, 18 U.S.C. §115 (a)(1)(B). That law states:

“Whoever threatens to assault…. or murder, a United States judge… with intent to retaliate against such… judge…. on account of the performance of official duties, shall be punished (by up to six years in prison)”

IMO, there's no "may" about the violation.

Charges for a federal crime are brought by federal prosecutors.

If AG Gonzales is unwilling to pursue, the only recorse Lautenberg has is to call for a special prosecutor.

And, come to think of it, wouldn't Gonzales be guilty of obstruction of justice if he does not act?

For some reason I wouldn't hold out hope for Gonzalez to act, or if he did, for it to go anywhere...One can only hope though that this bit of idiocy is another can of gas on the bonfire that is Delay...

Though you did mention that states may have laws against this, so maybe a state prosecutor in the state he was IN can prosecute? Where was he when he made the threat? I guess that's sorta where I was getting at originally...

48. Not necessarily.
State courts routinely prosecute violations of federal law. Federal law is the law of the States, and state courts do have the jurisdiction to prosecute federal violations.

was verbally a little more prudent, warning him that guns would be waiting for him down South.

Delay must be continually hammered and nailed on the Ethics issue until he is squeaking inside some cowardly rathole far away from the cheese.

The assault on the judiciary must be faced down, head on, as the assaults on legislatures and the executive should have been as well.

This must be a wedge against the appointment of ALL GOp nominations coming from the House. The well is poisoned.

Helms told him not to visit military posts in NC if he cared about his safety, I remember cause I was stationed at Ft. Bragg at the time and my parents asked me what I thought about that after he said it, I thought it was just the words of a senile old coot heh...

Realistically, I doubt that “The time will come for the men responsible for this to answer for their behavior.”, could be proven to be a threat of violence. There's too much plausible deniabilty.

But I see and hear similar comments frequently made by many people on all sides. Isn't there anyone here that hasn't at some time said that Bush will be held accountable? How would we react if a comment like that was interpreted to be a threat of violence?

35. No need to retract - just clarify
that he meant "in the next world" or something and he'd be okey dokey. Failure to clarify that he meant God would judge and we humans shouldn't take matters into our own hands, well, that could easily lead to the impression that he does, in fact, favor such vigilante action.

Dear Majority Leader DeLay,


I was stunned to read the threatening comments you made yesterday against Federal judges and our nation’s courts of law in general. In reference to certain Federal judges, you stated: “The time will come for the men responsible for this to answer for their behavior.”


As you are surely aware, the family of Federal Judge Joan H. Lefkow of Illinois was recently murdered in their home. And at the state level, Judge Rowland W. Barnes and others in his courtroom were gunned down in Georgia.


Our nation’s judges must be concerned for their safety and security when they are asked to make difficult decisions every day. That’s why comments like those you made are not only irresponsible, but downright dangerous. To make matters worse, is it appropriate to make threats directed at specific Federal and state judges?


You should be aware that your comments yesterday may violate a Federal criminal statute, 18 U.S.C. §115 (a)(1)(B). That law states:

Threats against specific Federal judges are not only a serious crime, but also beneath a Member of Congress. In my view, the true measure of democracy is how it dispenses justice. Your attempt to intimidate judges in America not only threatens our courts, but our fundamental democracy as well.


Federal judges, as well as state and local judges in our nation, are honorable public servants who make difficult decisions every day. You owe them – and all Americans – an apology for your reckless statements.

42. I love Lautenberg, a genuinely intelligent, clever, and very tough guy.
He's succeeded at everything he's done and these are the reasons why. Good for him, put this DeLay guy on notice, you're cruising for an inditement when we take control. The statute of limitations on this would be interesting. I pray that no one is hurt as a result of the DeLay insanity. If someone is, it will fall on Bush and DeLay for pandering to lunatics (yes, there is only one side of this issue sanity).

I applaud Lautenberg for sending the letter, but he's got to know it's a red herring.

Assault requires specificity and immediacy. A federal charge for assault on a judge would part of a general assault charge. It is not a freestanding charge.

Nonetheless, I do like the idea of shutting that idiot Delay up. I hope he's too dumb to realize that Lautenberg's having fun at his expense.
