For those who didn't see the other threads that were locked. . .and in complete accordance with DU rules. . .pullease do not incite harrassment here.

Enough money was raised out of the kindness and generosity of many to afford Andy Stephenson his much needed "Whipple Procedure." though he was scheduled for the procedure to be performed today, Paypal said that he couldn't access the funds for the procedure for several days. John Hopkins needs the money up front.

He had said something about Paypal accusing him of fraud. I can only speculate but given all the work he did for our democracy, gratis. And what he's gone through over the past 6 months or so. It's probably some clerical or accounting error.

Bottom line is that he needs this hassle like he needs a hole in the head.

The customer service number for Paypal is 888-221-1161.

Consider gently reminding them in a polite manner that they have his funds and that he needs them desperately.

Be nice let's not get this locked.

Having run a business on ebay in the past and dealing with paypal I will relate my experience

I used to sell electronics on ebay and most of my buyers used paypal to pay. In my first few months I got alot of sales and alot of very high dollar payments. After the first month in business I had acquired $35,000 in my paypal account. I received a letter from Paypal saying that my account was being suspended due to possible fraudulent transactions and all my money was being frozen.

I called paypal immediately to get an explanation and to ream them a new one. I was told that they have people and equipment in place that observe ALL of your transactions. If something happens to your account, such as a large amount of payments that go outside the norm for your average usage history or you get a substantial amount of payments in the same amount, then these are enough to trigger your account being flagged to be investigated

I had to present them with all kinds of documentation to affirm to them that I was not doing anything illegal such as a pyramid scheme or money laundering..but it did take two days

72. 2nd update...talked to Resolution center...very polite
he said the best advice he could give would be for Andy to call the resolution center and discuss the account with them further. I asked him to note on the account that I was calling to express that the funds were legit, and that this would be a lifesaving decision to release the money. I mentioned Air America Radio and Mike Malloy, as well as DU having 60,000+ members (and to expect more phone calls from us), as well as the fact that this money was raised in literally two weeks.

Please have Andy call back if he can, perhaps with the few calls that have come thru already things may change...

ps-I know he looked at Andy's account but didn't discuss it with me in detail; he asked for the account email addy and checked it out. So make sure you ask them to note the account that you called so every single call gets notated!

7. Could someone clarify if it is the monies donated toward the
2nd half owed to JH or all monies donated through paypal during both donation drives that is being withheld? The reason I ask is if it is the full amount donated I can point out my specific donation being witheld from Andy as a paypal member which might give me an even stronger argument when I contact them.

It took a few minutes to get through the voice recognition prompts. I just finally said "customer service" (which is not an option) and then went into a musak queue.

I've now been holding for 5 minutes.......

edit: I explained the situation. The customer service nazi said she could not go another's account so she could not answer my question why funds were being held.

Is it appropriate to contact PayPal in this manner? I would hate to harm his situation by testing the PayPal's wrath, after all.

I believe that their policy is clear, in terms of non-collectibility of funds, but it also seems clear to me that someone in the bureaucratic chain must have yea/nay authority over such matters.

Has this story made it to any part of the MSM? I'd think that this is the kind of thing that PayPay would love to make public (assuming that they step up and release the funds), because it would showcase them as an instrumental part of this life-saving procedure, and how can you buy that kind of publicity?

I confess that I haven't been able to follow all of the threads, but it seems astonishing that Johns Hopkins must have all payment up front. It's not as though he's going to make a break for it immediately post-op, and goodness knows that bankruptcy rules won't let him default.

What a stupid, stupid load of shit for him to have to deal with.

17. I know Malloy mentioned it on AAR, but I haven't seen anything
else in regular media... Daily Kos had a bit on it, and Will Pitt's blog has a great letter (that's what malloy read on the air).

I plan on just saying, I am following a story of an individual online, his name is Andy Stevenson, and I understand Paypal has frozen access to the funds donated to him for surgery. I donated to this fund and I wish to express that this is a legitmate fund for Andy, who has cancer and must have the funds upfront for lifesaving surgery. Please release the funds to Andy.

and that's it. I will be nice and perfunctory, I don't want to piss them off either. I am on hold right now... blech.

Unless you have power of attorney or hold the account absolutely not.

It would be akin to walking in to a bank and expecting to deal with someone elses account.

Obviously I wouldn't say "hey, release the funds in account XXXXX-XX on my authority." Instead, I wondered if PayPal would respond unfavorably to policy inquiries, or if such general questions might be fruitful.

Otherwise, what was the point of including the customer service number in the original post, if not to encourage call-ins from people who have no actual authority on the account?

Their resolution department's number is 1-402-935-7733. It might help bypass all the press this button.

I talked to someone named Annette, who seemed helpful, but someone more knowledgeable needs to call. Andy or one of his key fundraisers.

Do we know if this is going to be a problem with John Hopkins? Can we provide evidence of the funds? Can paypal issue a statement that the funds are in hand, but it will take a couple of days to release them. Can we show proof of the fund raising efforts here on DU and elsewhere.

If they balk, can we contact a consumer reporter in Baltimore to rattle their chain. We can also contact John Hopkins PR department. A group that can raise that much money can make a lot of noise. A PR person can grease some wheels that an accounts person might not be willing to.

Whether or not we like it, we are represenatives of the Progressive Movement.

Much attention is paid to us.

We can stay calm here, and calmly express our views without HARASSMENT.

I agree.

I'm proud of this DU effort, and I believe that it will go down in history as one of the better progressive efforts.

I think that the JH facility ought to be aware that much bad publicity will result, whether anyone wants that or not, if the admittance and procedure does not happen. And I have never in my life advocated harassment, and I don't now. But it is fair to say that negative publicity will probably result if things do not go down as scheduled.

And I hope and pray that the administrators of PayPal and JH are fully informed before they make any decisions (of the nationwide effort). That is only fair, for they will take the brunt of any negative publicity.

I'm praying that everything will go well.

I know it will.

We just need to be patient.

18. I do know that Paypal takes days to clear payments.
A lot of people do drafts against their checking account (I do) and it takes a couple days for the money to come out of my account and go into another account.

This is not PayPal fault.

So money donated on this weekend when banks are closed would not be available until probably Thursday.

Although my payment to Andy did not go through Paypal, I have a *business* paypal account, WITH FUNDS sitting in it. I will be more than happy to close my paypal account, withdraw all of my funds, and let them know exactly why I am doing so. However, I will eagerly be waiting for one of our "captains" to speak before taking action.

The way I am going to approach this is to ask for confirmation that the monies I sent to Andy via paypal have been released and received by him and give them the transaction # that was sent to me from them. This way I am enquiring about my account, my transaction and not about Andy's account. I hope this way will work.

Edited to add: just read that it is being sorted out, am glad to hear that!!

Edited to add again: I stayed on hold just so it could be recorded as a call re-affirming my donation was intended for this person and to ensure he received it. I was very polite and thanked the fellow for his time at the end of the conversation so I don't think it will harm anything.

He's saying I need to tell him who manages Andy's account, which I would think they would have a record of; I certainly don't.

I'm back on hold again, because I just asked to speak to someone else. Between the accent and the logic, I didn't get very far with the first guy. This is frustrating.

67. They figure that if you do not know who manages the account,
it is not any of your business. Imagine if someone called them and asked about your account. Bureaucracy has it's purpose of preventing fraud, but sometimes (as in this case) its inflexibility is harmful.

He gave me a public relations phone # (408)558-7400. That's the PR # for PayPal. I told him not to worry about a thing...his "pitbulls" had it handled. Apparently, he has a generous friend who is willing to cover the amount until it is released so DO NOT PANIC!!!

that I know Andy personally and that there is no fraud involved but simply a cancer operation. The manager I spoke to said he couldn't go into details but that one of the problems might have been that Andy had a personal instead of merchants account (apparently), which cannot access a lot of money quickly. He said they are working on the problem as we speak. I told him that I understood that this is an unusual situation for them but if we had had more warning from the hospital, we would have had the time to send checks in and wouldn't have bothered them with this at all.
I kept myself very calm, although I did mention that Andy's friends include a number of lawyers and media savvy bloggers who are all looking forward to Andy getting his operation on time.

He gave permission to post his ID number here: E3053

He explained that it takes days for the process of transferring funds, even if they release the money immediately. And he confirmed that they need Andy or whoever is handling his account to call and give a bit more info to clear the account to receive the money - which it sounds like someone is already handling.

He was open to the idea of faxing confirmation of the funds to JH - which also it sounds like is being handled at this point.

94. The surgery initially was scheduled for June then moved up to Tues which
is why the rush to get the rest of the payment by today. (This according to flyarm who was involved in getting Andy seen by JH.) It was always the plan to have the funds up front but the surgery date got moved up.

And I'm sorry that I wasn't thinking and didn't mention this before.
If you have an ebay auction, or whatever, when you go to withdraw the money the only way you can do it instantly is if you have their debit card. Otherwise, to have it withdrawn into your bank account, it takes 3-4 days.

Too bad none of us had that come to mind before, sorry Andy!

Of course, accusing Andy of fraud is not cool, and I'm glad everything has worked out.

large deposit. The bank will wait until all checks clear before releasing the money. I also think that any transaction over $10k must be reported to the Federal Government per the PATRIOT Act. Although the money may have come in via many small donations, it all adds up to more than $10k.

Also, Since this is coming into Andy's personal paypal account it may be treated by the IRS as income and subject to taxes. I am no lawyer but it might be a good idea to incorporate Andy if there will be additional fundraisers on his behalf.
