If in fact the Senate goes nuclear and approves of the Judges in question, could a House Democrat move to Impeach as they were put is in an unconstitutional way?

It's just been part of the Senate rules for about that long. So unfortunately, nothing unconstitutional about doing away with it.

There is nothing unconstitutional about changing Senate rules. Anyway, the only grounds for impeachment are crimes committed by the judge. Besides, it ain't gonna happen. The House won't and the Senate would not convict.

but with the house controlled by the repubs, that would never happen. Additionally, it is not against the constitution the way this is happening. The repubs are just trying to change the Senate rules in the middle of the game in order to get their way.

The Senate minority leadership would sue Cheney in federal court for breaking the Senate rules.

Impeachment is a very remote, almost infantesimal, nay magical possibility. Right now, the congress is in the hands of the repukes. In fact, it is in the hands of the administration. They are not going to even consider hearings leading to impeachment, much less vote a bill of impeachment.
Sad to say that it is a complete impossibility at this time. If we get either house back in 2006, perhaps. Even then, the appetite for impeachment, post the last one, cannot be strong. An impeachment is a grave national crisis, played out on TV. Although it was trivialized last time around, it is hardly trivial.
