Judge asked for evidence of Posada terrorist activity in Bay of Pigs!!

But as the hearing wound down, the judge dropped a bombshell in the courtroom. He informed both the attorneys for Posada and for the U.S. Government that he would issue a pretrial order in late July or early August requiring counsel to brief the court as to whether or not Posada’s actions in support of the Bay of Pigs invasion could be construed as terrorist actions under U.S. statutes governing detention and deportability of aliens. Abbot then pointedly noted that he looked especially forward to the government’s brief on that matter.

The court was silent. An immigration judge had just ordered a brief as to whether or not an action 43 years ago supported and funded by the U.S. government in accordance with policy taken at the highest levels, including presidential decisions, could be construed as a terrorist act under current U.S. law.

As Javier Montaño, Posada’s second-chair counsel, translated the judge’s statement to Posada, a hint of a smile came over the old man’s face. No doubt the irony was not lost on Posada, and one wonders if he will take the stand and testify at his August 29th hearing on his asylum application.

If Posada does testify, the definition of terrorism will not be the main legal issue, but it will certainly be the most salient issue in the courtroom. And we wait with anticipation to see how Judge Abbott rules with respect to whether or not Posada’s participation in the Bay of Pigs action qualifies as a terrorist act under present U.S. law.

1. Why do I get the vague suspicion that this will be twisted inside out,
upside down, and backwards and will be the way Posada Carilles gets off?

I sometimes worry about how negative I've become. But really, I am rarely disappointed in the human race as long as I keep my expectations low. And I am never disappointed by the bush** administration as long as I expect only the worst.

2. The AP article is titled "Judge denies bond to Cuban militant"
Wonder if anyone would even bother reading the article with that headline.


Even if Posada is extradited as a terrorist, will anyone even be aware because the corporate media will of course bury it behind a dull misleading headline then quickly move on?

This is from today's Miami Herald Jim DeFede's op/ed column..

Soto {Posada's lawyer} then sought to change the subject and started praising Posada's patriotism.

''My client has been a soldier of the United States for 40 years, whether he is officially or unofficially today on the payroll,'' Soto said. ``My client absolutely loves the United States. My client is enamored of the principles of this country. My client put his life on the line on numerous occasions for the red, white and blue. A lot of the people out there perceive this or look at this as him being a simple terrorist, a bad guy and he should go to hell for it. Excuse the bad word. But the bottom line is my client is a product of this country. He was trained at Fort Benning in 1963. He has served in the Central Intelligence Agency. He was in El Salvador in the mid-'80s.''

I suggested it sounded as if Soto was admitting his client was responsible for the bombings.

''I won't get into whether he admits to it,'' Soto said, ``but I will say this to you: We have boys that have lost their lives in Iraq, to the tune of about 1,500 over the last 18 months, and some of those boys, before they died, also took the lives of other boys, someone else's sons. Whether or not you believe in what we are doing in Iraq, they are still U.S. soldiers. . . . ''

''Please don't tell me you are comparing Posada to U.S. soldiers in Iraq,'' I interrupted.

''You know what, I am, I am,'' Soto exclaimed. ``Luis Posada Carriles is a man who is at the vanguard of a point of view that many people in this country believe in.''
