Quick question regarding recess appointments... |

I know that Bolton gets to serve to the new Congress in January 2007. That's also how it works for federal justices, I think. My question is, what positions are eligible for the president to make recess appointments? Most specifically and importantly, if the Dems in Congress stall on Roberts for one reason or another, can Bush make a recess appointment to the Supreme Court?

Supreme Court justices can be recess-appointed, too. It's been done 11 times.
