Whew! This case had me seriously worried...
INDIANAPOLIS --A judge who ordered two Wicca believers to shield their son from their "non-mainstream" faith overstepped his authority, an appeals court said Wednesday in dismissing the order.

The Indiana Court of Appeals said state law gave a custodial parent the authority to determine a child's upbringing, including religious training. A judge could find that certain limitations were needed to protect a child from physical or emotional harm.

The parents' appeal, brought by the Indiana Civil Liberties Union, claimed among other issues that the decree was unconstitutionally vague because it did not define mainstream religion. But the appeals court based its ruling on state law.

1. Been waiting for this to be overturned myself...
Glad to hear it. I'm not even close to religious, but I was still aghast by this idiocy.

4. It was the only possible outcome.
The original ruling was so blatantly unconstitutional it didn't have a chance. The facts that BOTH parents are Wiccan, had made no petitions regarding religious training, and the judge inserted the "mainstream" restriction completely on his own made an overturn on appeal inevitable. Talk about your "activist" judges.... :crazy:

6. I was worried for the judge, to be honest
His ruling was so anti-Constitutional that I thought he might not just laughed off the bench, he might be deported.

Actually, I wasn't worried at all for the judge. But the decision he rendered was one of those things that suggest the onset of the Delerium Tremens, a psychotic break, or Alzheimer's disease.

And I say that with no defamation intended toward those so afflicted, mind you. I just find it astonishing that ignorance can accomplish in a moment what physiologically-caused mental illness requires a year or more to cause.

7. The original ruling stopped me in my tracks...
One thing I have to give the Judicial branch is that they've generally left religion alone. I certainly didn't want to see a precedent for it going the other way.

I guess there are still a few non- Federalist Society judges out there.
