Lawyer Asks N.M. Court to Order Recount By BARRY MASSEY, Associated Press Writer

SANTA FE, N.M. - The state's highest court was asked Monday to order a recount in the razor-close 2004 presidential election in New Mexico even though it's too late for a new vote tabulation to change the outcome.


A lawyer for Green Party presidential candidate David Cobb and Libertarian candidate Michael Badnarik made the request to the New Mexico Supreme Court during a hearing on a challenge to the state's handling of the candidates' request for a recount.

Cobb and Badnarik contend they were wrongly required to pay $1.4 million as a security deposit for a recount, which never happened because of the legal dispute over the cost.

3. Yep. It's been argued before the NM Supreme Court and now
we have to wait the decision. It can't change the election results but if it is shown that the shrub lost, it can send a powerful message. :)

I realize it legally doesn't matter anymore, but it sure would be great to ahve proof of Shrub being an imposter! I sure wouldn't let anyone forget it!

5. Excellent. Keeping my fingers crossed the recount will change the EV
Even though, it wont overturn the election results, if Kerry really won NM and we have proof of this, it will help to de-legitimize and disempower *'s presidency a little more.

As much as I would like to be excited about that, this is no remedy.

The data has been in the hands for the past EIGHT months private parties who could have quite easily been manipulated and "tailored" by now.

If Im correct, this recount, I hate to break it, is proof why recounts are essentially a waste of our time and energy when the ballot data is now electronic data primarily and in addition has been in the hands of private companies who could have easily manipulated all the results to whatever result they need, within the past eight months.

It's not recounts that are important as much as eliminating the private companies from our ENTIRE voting process and removing the electronic machines like Montana has, and using PREVENTATIVE measures and having community folks counting the votes, not the private companies.

36. Back when the request was made, (we) asked for a specific
type of recount that included a close look at the programming.

Albuquerque was having a two year ongoing problem with 'ghost votes' but they were quick to assure everyone that they knew exactly which votes to delete -- about 6,000 per election.

Kerry lost by about 6,000 and that didn't include the funny business outside of New Mexico.

About this time I had to withdraw from working stuff due to my father's pancreatic cancer, so I can't tell you what happened next....
