The question EVERYBODY who interviews DeLay should be asking
Edited on Thu Sep-29-05 10:34 AM by Walt Starr
"Mr. DeLay, why did you 'under advise and consent of counsel, knowingly, intelligently, and voluntarily' waive the statute of limitations on the conspiracy charge?"

4. You're damned straight he did!
Read it for yourself:

"The Grand Jury further presents that, with the advise and consent of counsel, the defendent, Thomas Dale DeLay, did heretofore knowingly, intelligently, and voluntarily waive application of Articles 12.01 and 12.02 of the Texas Code of Criminal Procedure to the indictment presented herein. In particular, the Grand Jury present that with the advice and consent of counsel, the defendent, Thomas Dale DeLay, did knowingly, intelligently, and voluntarily waive the requirement that an indictment for the felony offense of criminal conspiracy, the object of which is felony other than those listed in Subdivisions (1) and (5) of Article 12.01 of the Texas Code of Criminal Procedure, may be presented within three years from the date of commission of the offense, and not afterward, insofar as such requirement pertains to the indictment presented herein,"

Bottom of page three of the indictment:

and the top of page four of the indictment:

DeLay copped a plea bargain. Why else would his counsel advise and consent to waive the statute of limitations on an offense he could be indicted on? What's more is, he met with Earle on August 17th. THE STATUTE OF LIMITATIONS ON CONSPIRACY HAD ALREADY RUN OUT!!!

5. So let me get this straight...
Delay is copping to the conspiracy charge in a plea bargain deal because he could face more serious charges? Do you have any ideas as to what those more serious charges might be? Wouldn't you love to see the details of that plea agreement...

8. Plea bargains are never entered into the public record
You would have had to been privy to the meeting held on August 17 to know what went on, sadly.

10. This seems likely.
I was wondering why someone would cop to something they couldn't be prosecuted for.

6. As I said in another thread, this could be a standard tolling agreement.
If DeLay was told, as his lawyer insists, that he wasn't a target of the investigation, then it's certainly likely that his attorney would have agreed to toll the statute of limitations, thinking somebody else would take the fall.

as if Tommy Boy is actually goign to trust anything a "partisan fanatic" tells him and as if his attorney would advise and consent signing away something for nothing in return.

9. Bottom line for me is
he proclaims complete innocence of ALL charges, but made plea deals. If one is innocent, why cut a deal on anything? Unless, of course...one is NOT innocent and just trying to get the best 'deal'.

17. Oh yes, Tom Delay is going to trust a "partisan fanatic" prosecutor
and sign his little waiver. Guergin would believe that too, and have Tommy boy sign away something for absilutely nothing in return.

Right.

And the tooth fairy is paying 'em a visit tonight.
