A different grand jury whose term ended last week indicted him on a conspiracy charge, forcing DeLay to temporarily step down as House majority leader.

Both indictments accuse DeLay and two political associates of conspiring to get around a state ban on corporate campaign contributions by funneling the money through the DeLay-founded Texans for a Republican Majority Political Action Committee to the Republican National Committee in Washington

100. Yes, they have a hard time spelling 'huge'
they forget to hold down the Shift Key and a row of exclamation points comes out as !!1!

Also - series is FR for serious. Too many vowels in a row seems to confuse the poor buggers.

The other indictment was IIRC fraud, but the scheme was essentially money laundering. Is this a new indictment?

The new indictment comes hours after DeLay's attorneys filed a motion to dismiss the case. That motion was based on the argument that the conspiracy charge against DeLay was based on a law that wasn't effective until 2003, the year after the alleged money transfers.

"Since the indictment charges no offense, and since you have professed not to be politically motivated in brining this indictment, I request that you immediately agree to dismiss the indictment so that the political consequences can be reversed," attorney Dick DeGuerin wrote in a letter to Travis County District Attorney Ronnie Earle.

I knew the Texas Grand Jury expired on Friday so I just figured that this story was one of those "oops" moments. Turns out it was, but for me, not the OP!! Man those Texans know how to keep things secret. Eight gazillion stories about the first Delay indictment and not once did I hear anything about a second Grand Jury! Well, that'll teach me to leap before looking!!

I was loathe to admit it, but I kept thinking that DeLay would beat the conspiracy rap, if that's all there was, and that would return him to DC stronger than ever.

generally requires an agreement between two or more people to commit a crime and then someone (doesn't have to be the defendant) to commit what is referred to as an "overt act" in furtherance of the conspiracy. If you and I agree to rob the bank and then you go buy us some ski masks, I could be tried for conspiracy if it could be proven that we had such an agreement and that your purchase of the masks was for us to use robbing the bank. Conspiracy is actually very easy to prove in many cases (contrary to some of the opinions I have seen here) because most such cases involve one or more of the conspirators "flipping" on the others. The agreement is proven because one of the conspirators is willing to testify against the others in exchange for leniency. No actual criminal act, other the the act of agreeing, is required to convict a defendant. The corollary of course is the old saying "If nobody talks, everybody walks".

The first indictment wasn't for a "real" crime, so Earle had to throw up a new politically motivated indictment to save face. According to DeLay's lawyer, this is a new indictment for the same crime.

And now putting on my bullshit detection glasses, it's clear that Earle is indicting DeLay for both money laundering, and conspiracy to commit money laundering.

A different grand jury whose term ended last week indicted him on a conspiracy charge, forcing DeLay to temporarily step down as House majority leader.

A criminal conspiracy charge against U.S. Rep. Tom DeLay should be dismissed because conspiracy laws did not apply to the state election code during the 2002 election, DeLay's lawyers argued in a brief filed today. The filing represents an attempt at a quick knockout of the case against DeLay, who was indicted last week by a Travis County grand jury. The term of the grand jury ended last week and a deadline to indict DeLay might have expired since then.

DeLay's lawyer Dick DeGuerin said "rumors are flying" that prosecutors were trying to find a sitting grand jury, who hadn't heard any of the DeLay case, to return a new money-laundering indictment. In a letter to Travis County District Attorney Ronnie Earle, DeGuerin said DeLay is withdrawing his waiver of the statute of limitations to investigate him. Last month DeLay signed that waiver in an attempt to head off an indictment.

In the brief, DeGuerin argued that the conspiracy statute did not apply to the election code until the Legislature amended the law, effective Sept. 1, 2003, after the 2002 election.
