Federal courts closed October 17 (for bankruptcy) |
|
For those of you planning to file bankruptcy before the Draconian new law takes effect on October 17, do not wait for the last minute. My lawyer informed me this morning that the courts will not be open for regular business on 10/17 so they can "prepare for the new bankruptcy laws." So make sure you file by Friday, October 14. You won't be able to file on Monday...

1. That could cut out a lot of people |
|
It looks like it was meant to. What a farce. What good is a deadline that isn't really a deadline?

3. Possibly this may confuse Columbus Day (Oct 10) with Oct 17 |
|
At least in the western district of Washington state, the bankruptcy court is scheduled to be open. The policy may be to close in other jurisdictions however, so I can't rule out this rumor entirely. Caution is advised, check with your local bankruptcy court.
this rumor may cause people on the 17th to give up, also not a good result.
Federal court holidays are: New Year's Day January 1 Martin Luther King, Jr. Day 3rd Monday in January Presidents Day 3rd Monday in February Memorial Day Last Monday in May Independence Day July 4 Labor Day 1st Monday in September Columbus Day 2nd Monday in October Veterans Day November 11 Thanksgiving Day 4th Thursday in November Christmas Day December 25

4. My lawyer didn't specify if the court itself would be closed |
|
or if they just weren't taking any new filings. He said the deadline to file under the current rules in Friday the 14th. The clerks at the court are going to spend the 17th getting ready for the new rules. He is highly dubious that the court would need the day to prepare and believes it is entirely being done to screw last minute filers, but those are the guidelines he has been given.

5. i thought the new law applied to filings made on the 17th or after |
|
So the "last minute" would be on Friday, not Monday and it wouldn't be screwing anyone.
Can anyone confirm effective date?
