WASHINGTON — Federal prosecutors have accepted an offer from presidential adviser Karl Rove to give 11th hour testimony in the case of a CIA officer's leaked identity but have warned they cannot guarantee he won't be indicted, according to people directly familiar with the investigation.

The persons, who spoke only on condition of anonymity because of grand jury secrecy, said Special Prosecutor Patrick Fitzgerald has not made any decision yet on whether to file criminal charges against the longtime confidant of President Bush or others.

The U.S. attorney's manual requires prosecutors not to bring witnesses before a grand jury if there is a possibility of future criminal charges unless they are notified in advance that their grand jury testimony can be used against them in a later indictment.

Rove has already made at least three grand jury appearances and his return at this late stage in the investigation is unusual.

7. Read the article CAREFULLY...
It says Rove made this offer to come back in July, and Fitz is just accepting it now, with the warning that what he says can be used against him.

It does not say Rove is actually going to turn up and testify again as promised, he may choose not to do so given the circumstances.

8. My bet is that something like the following course of events transpired:
1) On previous occasions, Rove lied to the Grand Jury
2) Rove's story has fallen apart
3) Rove got a "target" letter essentially giving him a chance to make a deal. Since no indictment has yet been issued, Fitz still has a lot of latitude on the contents of the deal.
4) Rove thought it over & decided he was gonna save his own fat ass by flipping.
5) Fitz accepted Rove's deal & is bringing him back for another command performance, at which Rove will give testimony implicating...guess who.

"I can say categorically that Karl has not received a target letter from the special counsel. The special counsel has confirmed that he has not made any charging decisions in respect to Karl," Luskin said.


Somebody's lying.

Unless Karl got a letter, he can't tesify. The source says he COULD be indicted, but Luskin says Rove didn't get a letter.

Or am I missing something?

From the article:
Rove offered in July to return to the grand jury for additional testimony and Fitzgerald accepted that offer Friday after taking grand jury testimony from the formerly jailed New York Times reporter Judith Miller.

Before accepting the offer, Fitzgerald sent correspondence to Rove's legal team making clear that there was no guarantee he wouldn't be indicted at a later point as required by the rules.



Interesting that Fitzgerald accepted the offer Friday and it's Thursday now.

19. Um, splitting hairs? Fitz's notice constitutes a "target" letter,...
,...since it specifically makes clear that Rove may still be indicted.

Fitz requested Rove return to the GJ. Rove offered in July to give further testimony. Fitz accepted the offer, sending a notice that Rove is still subject to indictment.

"Target" notification kinda' like works that way.

Maybe that could be a way Rove's lawyer could weasel out of saying Rove received a target letter.
Since I'm no lawyer, I don't know the technicalities about these letters and was just pointing out what the article said.
In either case, I think Fitz is playing some calculated cards in the time and the way he wants and that he has the upper hand - would love to see a royal flush.
