Poll question: If tobacco's liable for 2nd hand smoke, what about 2nd hand lead?
Bullets go through walls, people and just about anything unless you are behind one of those magic Hollywood trash cans that can save you from just about anything up to a 50 megaton thermonuclear device if you hide behind it.

The smoking industry has been called on 2nd hand smoke...

The NRA backed gun industry gets a get out of jail free card.

What gives?

So, the question goes: Ossifer Opie has enough and decides to eat a bullet in his patrol car. The bullet goes through the roof, into your house, bounces off your head, you trip over your coffee table and break your neck.

Your family decides they want to hold someone responsible other than the dead guy. Should they rightfully sue:

4. Sue McDonalds!!
Opie was probably overweight and that's why he killed himself. And we all know people are overweight because the fast food industry hypnotizes, brainwashes, & feeds us addictive substances, so we can't help but go there to eat.

5. The person who shot the gun is liable
Just as if I dumped a bunch of poison in the ground, I would be liable for the hurt people & property and not the manufacture of the poison. Guns do exactly what they are designed to do, shoot a piece of lead at a high speed.

Now, if a manufacture started making guns that back-fired, exploded, jammed, etc, they have responsibility for that.

6. Opie himself, or no one.
What's the rationale behind NOT blaming Opie? Sentimentality? Can't blame the guy who PULLED THE TRIGGER, So instead you're gonna find someone, ANYONE else to finger.

Let's rephrase this: A cop sees someone speeding. So he pulls you over to give you their ticket, because he didn't have the heart to chase down the real speeder, who might just be late for their kids soccer game.

8. Everyone is responsible for thier own actions...
If you shoot at someone you are responsible for wherever that bullet ends up.

When a random citizen fires a gun and something bad happens the govt usually makes sure that citizen is punished.

However there is quite the double standard when it comes to government officials.

Whenever a police officer fires a gun and hits an innocent bystander the government usually just blows it off and claims "it was just an accident."

9. Guns are not made out of lead
why sue them? I guess you should go after the ammo makers. Oh and don't forget the paint makers how many thousands of died from lead based paint? oh and let's sue gas makers for making leaded gasoline. Dang Tom how do we end up on all the same threads together? Honestly I don't try.
