It's a citizens right to file a lawsuit and no person is above the law. It seems that the criminal lead up to trial and the civil case could run congruently.
The indictment has already proven compromising a CIA intelligence agent's identity at the very least. All that's required is to prove damages by merely a preponderance of the evidence.
I don't see why depositions could not be started. A conviction is not necessary to show Mr. and Mrs. Wilson's damages. Indeed the entire country's damages are being talked about already by fellow CIA agents.
It would send chills through the White House if the civil suit was filed. And there is no government immunity other than for actions taken in carrying out their federally charged duties in office.
Certainly disclosing the identity of an agent is not part of an official act required in performance of their duties.
It seems to me he could file it whenever he's ready.
