1. If he gets away with it, it means the LAW is whatever HE SAYS IT IS! |
In effect, he becomes Dictator if he is not held accountable.

2. I don't like the idea of spying on Americans |
But I have to concede that in some cases it might be warrented. The problem is that this administration was not willing to submit to the questions that need to be asked before spying on Americans. There should be roadblocks to spying on American Citizens; it should be difficult. But this administration just went around those roadblocks in a dishonest and unconstitutional manner. 5. For me it is a seperation of Powers issue |
The judiciary exists primarily to as a check against the unbridled power of the executive.
I do not he any great problem witht he surveillance per se. This is solely a matter of his failure to understand that he can not do what he wants to the American public under the cloak of being Commander in Chief.
I would have had no problem if he had gotted a court order...even after the fact. Bu the fact that he did not and that there was no oversight it both arrogant and scary.

6. If he had gotten a court's OK........... |
we wouldn't be having this discussion. So that would be first and foremost I guess, but his total lack of respect for the laws of this land are quite alarming. Of course he has all of his toadies whispering in his ear, "you can do anything you want, you're the president". This PNAC group has to disappear and never be allowed to darken our governments halls again.

7. Just a little item called the 4th Amendment to the Constitution. |
FOURTH AMENDMENT - 'The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.'
Having the goons poking around in one's life, conversations, writings, is illegal..not to mention immoral.

11. Yes. "Special judge" is reminscent of the Star Chamber. |
I have an aversion to any form of secret government activities. Supposedly, the people in a democracy are the government. How can we be "the government" if we don't know what's going on?
