Ahem;
THE TWU WORKERS ARE NOT BREAKING A 'NO-STRIKE CLAUSE'!
THE ARE NOT WORKING UNDER A CONTRACT, IT HAS EXPIRED.
They are BARRED from striking. Much the same thing as unions being forced by the government to represent scabby free riders in 'Right to Work for Less' states.

As a retired railroader and union negotiator, I'm well versed in it's provisions. One section states that "The old contract shall remain in effect until a new one is negotiated".
Companies can use this provision as a hammer to wear down a union. I was involved in negotiations where we went for 9 (NINE FUCKING) years without an agreement. And we were under a federal mediator for 8 1/2 years of that.
If the mediator had determined that we were at an impasse, he could have made a proffer of arbitration, and if either side turned it down, a 30 day cooling off period would have started, and we would have been free to strike after that. We demanded a proffer for years and never got it.
And the Mediation Board Member assigned to our case just happened to be the daughter of Bush Sr.'s Interior Secretary.

My brother is an engineer for CSX, my dad was a yardmaster. I remember my dad being on strike when I was about 9 years old. I didn't understand much of what was going on, but I learned what a scab was. Some of my dad's friends caved and went back to work. I've never seen him so angry, before or since.

what a great reflection of our times. to the media it's not about workers getting a fair shake. it's about retailers not making their quotas the week before christmas.
