Because Bush assumed he was granted the authority of the War Powers act to spy domestically, and because he was originally denied this power on Sept. 18th by Daschel, He EFFECTIVELY WAGED WAR AGAINST THE U.S. when he spied on U.S. Citizens.
And, He's ADMITTED TO IT ON THE RECORD.

Including, for example, Loral Corp. A company that reagan allowed to sell missile guidance system gear to China? (When Clinton renewed this, HE was branded a traitor and all - but reagan was merrily ignored... OTOH, Clinton gave China MFN status... but it was Nixon who went there in the first place and if people haven't seen the real reason by now, then they deserve to lose their jobs. I think every president since Nixon has had a dealing China found... favorable... too.)

While I'd personally be happy to have a sizable portion of the current administration hung at Fort Leavenworth (or wherever we do such things) but I'm going to take a guess here and say that no judge is ever going to convict George Bush of Treason, at least not for anything we suspect he had done already .... although there's no way to tell what we will discover he has done by this time tomorrow.
The key to impeachment isn't in the Treason end, its in the High Crimes end. Although I can't get anyone to nail down a good legal definition for me (no lawyer here) I'd have to assume that they meant Felonies and I believe an illegal wiretap, or a few hundred of them, would be good enough.
By the way, the section you cite is in Article III, which refers to the Judiciary.

By spying on U.S. Citizens without authorization, Bush committed an act of WAR against the U.S. (especially when he was EXPLICITLY DENIED that ability by Congress). And further, Bush has gone ON THE RECORD admitting to the act.
There has NEVER been a more CLEAR CASE FOR IMPEACHMENT BY TREASON than this.

What Bush has done is not only grounds for impeachment, but grounds for his execution as a traitor.
Here's the case:
Constitution of the US, Section. 3. Clause 1
Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.
Now in the past two days we've learned several things, including:
- that Bush is defending his actions, through the Attorney General's office, by asserting that he was given the authority to wiretap Americans though the resolution in which Congress granted him the authority to use force against Saddam.
- that Bush had explicitly sought such domestic war powers with Congress, but was rejected in negotiations prior to the vote.
- that the Attorney General's office says the word "force" implicitly includes the power to intercept and monitor communications of our enemies.
The case is clear. Bush has been waging war against the United States, itself, and against its citizens, by convicting them as enemies without a trial, and then by implicitly using "force" against them in a manner not authorized by Congress.
Lead him away in shackles.
