? about the guy shooting around the tree at the lawyer in Van Nuys
the other day. Did it ever come out what his beef with the guy was? He said something about "you took my money so this is what you get," but I was not sure what the situation was. I heard something about probate but nothing else. Anyone know what that story is?

3. The money in probate...
was part of the situation. The Trustee hired that lawyer to manage the $100,000 in the fund. Some of that money was necessary for back surgery for the shooter. The lawyer had put in a writ to the court, for Atty Fees...what was happening, was that the fund was being drained by fees, and the guy had waited for a year to get his surgery...apparently, he finally cracked.

This in no way, is how he should have dealt with the problem..but apparently, he saw no alternative. He was not going to get the surgery he needed, and the fund was being depleted rapidly.

That is the latest I've heard on this.

5. Question about the trustee thing.
Why was there a trustee? Wasn't there an executor to take it through probate? I'm a little hazy here.

This was definitely not the way to settle this case but I know the some of the frustration this guy has with the legal system. I had to be conservator for my mother during her course with Alzheimer's because she never signed a power of attorney and of course had to pay to pay to have a lawyer investigate me and go through all these never ending hoops before it got instituted. I can't imagine how much it would have cost to have had a court appointed conservator. Then my mother's husband decided to divorce her and it took 2-1/2 years to get through negotiating that. Probate so far seems to be the easiest of all this. NOTHING moves quickly except the lawyer's bill.

8. From what I understand, this was not over a Will...
Edited on Sun Nov-02-03 11:58 AM by rasputin1952
this was money in a settlement from a previous car accident that was set up in a TRUST account for purposes of treatment for injuries. (my mistake by saying it was in probate, I'm going by what I heard, and it is still being analyzed).

Apparently, this guys sister was involved somehow..but the main area of contention, is that the lawyer was taking 'fees' from the account, and NOT getting the treatment the guy needed.

This was on the news last night, the shooters lawyer was explaining what was going on. In essence, the fund was being depleted, and no surgery was on the horizon.

edited for spelling and clarity.

9. Because it was a trust.

And executor executes a will.

This was about a trust. When a trust is formed (whether by will or otherwise) a trustee is designated by the instrument forming the trust. Thus, there was a trustee.
